That the City Manager be authorized to sign a Local Transportation Project Advance Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the installation of a Bluetooth System to measure the wait times at the Paso Del Norte Port of Entry, for a total project amount of $129,516.60 with the City contributing a 20% local match of $24,918.

That the City Manager be authorized to sign a Local Transportation Project Advance Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department  of  Transportation,  for  the  reconstruction  of  intersections  at  Mesa  &  Resler,  Viscount  & Hawkins, Mesa & Sunland Park, Saul Kleinfeld & Montwood, Saul Kleinfeld & Pebble Hills, Viscount & Montwood, Airport & Founders, and Airport & Cassidy to include left turn lanes with modifications or additions to traffic control devices and pedestrian safety enhancements, for a total project amount of $1,617,450.00 with a contribution by the City of $135,960.00.

That the City Manager be authorized to sign a Local Transportation Project Advance Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the dedication and segregation of one bridge lane to be converted into a permanent Ready Lane at the Paso Del Norte Port of Entry, for a total project amount of $107,803.00 with a contribution by the City of $9,125.38.

That the City Manager be authorized to sign  a  Local  Transportation  Project  Advance  Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the construction or reconstruction of railroad crossings in the Five Points and  Medical  Center  of  the  Americas  Quiet  Zone  areas,  to  include  gates,  approaches,  signals,  and pedestrian  crossings,  for  a  total  project  amount  of  $2,183,600.00  with  a  contribution  by  the  City  of $183,656.00.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

That the City Manager be authorized to sign a Local Transportation Project Advance Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the reconfiguration of the Zaragoza Port of Entry passenger and ready lane to increase the number of lanes from 5 to 6, for a total project amount of $323,409.00 with a contribution by the City of $27,376.14.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

That the City Manager be authorized to sign  a  Local  Transportation  Project  Advance  Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the rehabilitation of the Kansas Street Bridge. The City is contributing

$16,609.00 toward the $377,483.00 project.

R E S O L U T I O N

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

That the City Manager be authorized to sign  a  Local  Transportation  Project  Advance  Funding Agreement by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the rehabilitation of the Santa Fe Street Bridge. The City is contributing

$17,367.00 toward the $394,749.00 project.

3.10.

R E S O L U T I O N

WHEREAS, in the interest of efficiency of administrative governmental operations,  City Council previously delegated authority to R. Alan Shubert, as City Engineer, to enter into and sign certain contracts on behalf of the City; and

 

WHEREAS, R. Alan Shubert is no longer the City Engineer for the City of El Paso; and

 

WHEREAS, City Council desires to consolidate the various delegations of authority to the City Engineer  into  one  document  and  update  the  delegation  of  authority  to  the  currently  appointed  City Engineer; and

 

THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            That the City Council hereby grants authority to the City Engineer to negotiate and enter into the following contracts and documents, in accordance with the guidelines established herein.

 

            That the City Council hereby grants authority to the City Engineer to act as the representative for the City of El Paso in matters relating to the acceptance or the acquisition of property interests, in an amount not to exceed $50,000, and the right to use property, including but not limited to licenses, leases, easements and deeds, associated with approved capital projects for the city; and to sign any and all documents necessary to complete the property transactions. This delegation of authority replaces the delegation of authority granted by Resolutions dated October 12, 2010 and April 10, 2012, attached hereto as Exhibit “A”.

 

            That the City Council hereby grants authority to the City Engineer, or designee, to sign on behalf of the City of El Paso, any and all title closing documents necessary to consummate the acquisition of real property to be used for City projects approved by City Council, in an amount not to exceed $50,000. This delegation of authority replaces the delegation of authority granted by Memorandum dated November 1, 2010, attached hereto as Exhibit “B”.

 

            That the City Council hereby grants authority to the City Engineer to enter into construction easements and right of entry agreements from private land owners in order to gain access to inspect, repair, maintain or construct City construction projects, provided that the consideration for such agreements is paid from the construction project funding. This delegation of authority replaces the delegation of authority granted by Resolution and Memorandum dated December 8, 2009 attached hereto as Exhibit “C”.

 

            That the City Council hereby grants authority to the City Engineer to sign all El Paso Electric Company Service Agreements, including interconnection and parallel operation agreements for City facilities from time to time as serviced is requested by the City. This delegation of authority replaces the delegation of authority granted by Memorandum dated May 18, 2010, and February 6, 2014, attached hereto as Exhibit “D”.

 

            That the City Council hereby grants authority to the City Engineer to sign Purchase Orders for the acquisition of any City goods and services for projects in the City’s Capital Improvement Program in an amount that does not exceed $50,000 per annum or an aggregate of $100,000 on a multi-year contract, in accordance with city Council approved purchasing policies as applicable, and that is approved as to form by the City Attorney prior to execution, provided, however, that if a standard agreement or form is used for any purpose, the City Attorney need only review and approve the standard agreement or form. This delegation of authority replaces the delegation of authority granted by Memorandum dated October 18, 2010, attached hereto as Exhibit “E”.

 

            That the City Council hereby grants authority to the City Engineer to sign all Utility Installation Request Agreements  or  such  substantially  similar  agreements  that  may  be  required  by  TxDOT  as  a  condition precedent for installation of City equipment within TxDOT right–of-way. This delegation of authority replaces the delegation of authority granted by Memorandum dated May 18, 2010, attached hereto as Exhibit “F”.

 

            That the City Council hereby grants authority to the City Engineer to sign TxDOT Multiple Use Agreements  for  sharing  Fiber  Optic  Cable  and  /or  Related  Infrastructure  or  such substantial  similar agreements that may be required by TxDOT from time to time as a condition of installing fiber optic equipment as part of the TxDOT fiber optic system, with further authorization from the City Council, upon review by the City Attorney. This delegation of authority replaces the delegation of authority granted by Resolution and Memorandum dated October 5, 2010 and

Memorandum dated April 24, 2013, attached hereto as Exhibit “G”.

 

            That the City Council hereby grants authority to the City Engineer to act as the representative for the City of El Paso in matters relating to the release of bonds and to sign any and all documents necessary to complete the release of the bond when all work for which the bond was obtained has been satisfactorily completed, the warranty period for all the work has expired and the bond has expired and upon review by the City Attorney’s Office. This delegation of authority replaces the delegation of authority granted by Resolution dated June 12, 2012, attached hereto as Exhibit “H”.

WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

1.        The City Council determines the actual cost of removing the accumulated trash, vegetation and weeds or other rubbish located on said property, being:

to be $170.76, performed by the Environmental Services Department of the City of El Paso, and, the cost of recording the Resolution in the office of the El Paso County Clerk, $34.00, making a total of TWO HUNDRED FOUR AND 76/100 DOLLARS ($204.76).  The City Council finds that the work was completed on the 17th day of October, 2013, and approves the costs described herein.

18th day of October, 2013, and approves the costs described herein.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

That the City Manager be authorized to sign a contract between the City of El Paso (“City”) and Texas Tech University Health Sciences Center at El Paso (“University”) for medical control services to the City’s EMS System (“EMSS”), for a three (3) year term from the effective date and one (1) option to extend for two (2) years under the same terms, for a cost of $120,000 for year 1, $123,000 for year 2, $126,000 for year

3 and a 3% increase for the option years.

Motion made by Alternate Mayor Pro Tempore Holguin, seconded by Representative Robinson, and carried that the City Attorney’s Office, is authorized to retain outside counsel in connection with the loan made to TVP Non-Profit Corporation for affordable housing in the Lower Dyer Neighborhood, and in consultation with the City Manager, shall be authorized to take any and all action necessary to protect and secure the City’s lien interests and position related to the loan. This Motion is intended to grant broad authority to take whatever action necessary to address these matters, including but not limited to the initiation and response to litigation, complaints, the filing of motions, and any other administrative or judicial proceedings or processes and any actions related to the City’s interest in the property located at A and B 3816 Harrison Ave., A and B 3326 Lincoln Ave., A and B 4011 Filmore Ave., A and B 4013 Filmore Ave., and a single family unit at 4010 Pierce Ave.
