BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            That the City Manager be authorized to sign an Interlocal Agreement between the City of El Paso (“The City”) and the Texas Department of Transportation (“TXDOT”) for the El Paso Police Department (EPPD) to provide uniformed officers and equipment necessary for law enforcement, general surveillance, and traffic control at and around sites for which TXDOT is providing maintenance, repair, construction and other services to State maintained roads and highways. Such services are to promote safety of construction zone workers and the traveling public. In lieu, TXDOT will pay up to $100,832.16 for this service on a reimbursement basis for actual salary and vehicle costs for a twenty-four month period March 22, 2016 – March 21, 2018.

            WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, MARTINEZ, SABAS , referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

to be $237.48, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 7th day of August, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount TWO HUNDRED THIRTY SEVEN AND 48/100 DOLLARS ($237.48) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            WHEREAS, on August 11, 1987, City Council rezoned the property described as all of Lot 9, Block 4, Hueco View Acres, City of El Paso, El Paso County, Texas, to C-1/sc (Commercial/special contract) and as part of the rezoning imposed a condition that a detailed site development plan be submitted for review and approval by the City Plan Commission and City Council prior to issuance of a building permit; and

            WHEREAS, the property owner, Dominquez Properties, LTD (the “Owner”) is ready to proceed with development and has submitted a detailed site development plan for review; and

            WHEREAS, the detailed site plan is subject to the development standards in the C-3/c/sc (Commercial/condition/special contract) District regulations and subject to the Detailed Site Development Plan signed by the Applicant, the City Manager and the Executive Secretary to the City Plan Commission; and

            WHEREAS, a report was made by the staff to the City Plan Commission and a public hearing was held regarding such application; and

            WHEREAS, the City Plan Commission has approved and herein recommends Council approval of the subject detailed site development plan; and

            WHEREAS, the City Council finds that the detailed site development plan meets all applicable requirements of the El Paso City Code.

WHEREAS, the Transportation Policy Board, comprised primarily of local elected officials, is the regional transportation policy board associated with the El Paso Metropolitan Planning Organization and the regional forum for cooperative decisions on transportation; and

WHEREAS, the El Paso Metropolitan Planning Organization has available approximately $1.19 million for the current Transportation Alternatives Program call for projects for Fiscal Year (FY) 2018; and,

WHEREAS, the City of El Paso intends to submit a transportation alternative project application for the University Avenue Pedestrian and Bicycle Enhancements project to the El Paso Metropolitan Planning Organization prior to the March 25, 2016 deadline; and

WHEREASthe Transportation Policy Board requires the submittal of a resolution as part of the Transportation Alternatives Call for Project application submission.

            THAT the City of El Paso supports the University Avenue Pedestrian and Bicycle Enhancements project as applied for in the 2017-2020 Transportation Alternative Program Call for Projects application, which has an estimated project cost of $856,584.00.

            THAT the City of El Paso will serve as the public sponsor and lead project contact and is requesting federal funding assistance in the amount of $577,801.00 as part  of its alternative project application for the University Avenue Pedestrian and Bicycle Enhancements project. 

THAT the upon the award of the City of El Paso’s application for the University Avenue Pedestrian and Bicycle Enhancements project by El Paso Metropolitan Planning Organization, the City of El Paso commits to fund and take appropriate steps to appropriate its estimated local contribution in the amount of $134,333.00 and estimated local match contribution estimated at $144,450.00, which is 20% of the estimated construction project cost  for the University Avenue Pedestrian and Bicycle Enhancements project minus the City of El Paso’s local contribution amount.

WHEREASthe Transportation Policy Board requires the submittal of a resolution as part of the Transportation Alternatives Call for Project application submission.

            WHEREAS, in May 2015, the Pan American Health Organization issued an alert regarding the first confirmed Zika virus infection in Brazil, and on Feb 1, 2016, the World Health Organization (WHO) declared Zika virus a public health emergency of international concern; and

            WHEREAS, due to this designation by the WHO, there are efforts at the federal level to appropriate dollars to combat the Zika virus; and

            WHEREAS, the City of El Paso’s Department of Public Health is working to ensure that the area is prepared should the Zika virus spread to our region and any federal funds available would help offset costs incurred.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            That the City of El Paso amends its 2016 Federal Legislative Agenda to include support for funding to combat the spread of the Zika virus.

Motion is made by Mayor Pro Tempore Noe, seconded by Representative Limón and unanimously carried that the City Manager is authorized to negotiate and execute, on behalf of the CITY OF EL PASO (“City”) for Economic Incentives to the  HOTEL SANCHO PANZA, LLC (“Applicant”), for the development of a Hotel to be located at the real property known and numbered as 616 North Santa Fe Street, El Paso, El Paso County, Texas; in accordance with the “Proposed Term Sheet for Hotel Sancho Panza Development” attached to this Resolution as Exhibit A and in a form and substance approved by the City Attorney to accomplish the intent of this Motion.
