Meeting was called to order at 8:02 a.m. Mayor Pro Tempore Cortney Carlisle Niland present and presiding and the following Council Members answered roll call: Ann Morgan Lilly, Larry Romero, Carl Robinson, Michiel R. Noe, Eddie Holguin, Jr., and Lilia Limón. Absent: Mayor Oscar Leeser and Emma Acosta requested to be excused. That the City Manager be authorized to sign a Non-Federal Preliminary Design Reimbursable Agreement (AJW-FN-CSA-14-2132) between the City of El Paso and the Federal Aviation Administration (“FAA”) whereby the FAA will provide services necessary for the modification or relocation of FAA conduit or cables as part of the Reconstruction of Runway 08L-26R Project at the El Paso International Airport. |

WHEREAS, the City owns the Star on the Mountain (“Star”), which is located on the south side of the Franklin Mountains in El Paso, Texas on property leased by the City from 88 Investments, Inc.; and
WHEREAS, the City has contracted with the Greater El Paso Chamber of Commerce Foundation on May 1, 2011 to operate a program for the lighting, operation and maintenance of the Star on the Mountain, which contract expires on April 30, 2014; and
WHEREAS, the City desire to continue contracting with the Chamber of Commerce to provides such operation and maintenance services and the Chamber of Commerce is willing to continue to provide such services for an additional five (5) year period; and
WHEREAS, the City staff recommends that the City contract with the Chamber of Commerce pursuant to the terms stated in the Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
THAT the City Manager is authorized to sign an Operating and Maintenance Agreement by and between the City and the Greater El Paso Chamber of Commerce Foundation for the operating and maintenance of the Star on the Mountain from May 1, 2014 to April 30, 2019 for the program services in an amount not to exceed $12,000 per year. Operating and Maintenance costs will be reimbursed in an amount not to exceed $50,000 per year. |

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
That the City Council approves the expenditure of additional available funding in the amount of Two Hundred Eighty Nine Thousand Two Hundred Seventy Three and 48/100 Dollars ($289,273.48) to Urban Associates, Inc. for additional construction costs for the Sun Metro Operations and Maintenance Facility, Solicitation No 2012-074. The change order provides for the architectural features, rough carpentry, sidewalks and fire suppression systems for the previously approved 6,000 square foot addition to the project, thereby adding 126 days to the contract time. The new contract sum, including this change order is Twenty Nine Million Eight Hundred Fifty Seven Thousand Four Hundred Forty Two and 08/100 ($29,857,442.08). |

WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, CARRILLO, RAFAEL, referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices. 1. The City Council determines the actual cost of removing the accumulated trash, vegetation and weeds or other rubbish located on said property, being:

to be $135.58, performed by the Environmental Services Department of the City of El Paso, and, the cost of recording the Resolution in the office of the El Paso County Clerk, $34.00, making a total of ONE HUNDRED SIXTY NINE AND 58/100 DOLLARS ($169.58). The City Council finds that the work was completed on the 22nd day of August, 2013, and approves the costs described herein.
2. R E S O L U T I O N
WHEREAS, Texas Transportation Code Chapter 311 grants home-rule municipalities exclusive control over and under the public highways, streets, and alleys of the municipality, including the assigning of street names to highways within the municipality; and
WHEREAS, the process for the naming of a state highway within a municipality is set forth in the Texas Department of Transportation’s (TxDOT’s) Signs and Markings Manual, Chapter 7, Section 18; and
WHEREAS, TxDOT’s Signs and Markings Manual requires the municipality enact a resolution or ordinance naming the highway and forward the resolution or ordinance to the TxDOT district office for review of the name; and
WHEREAS, Representative Ann Lilly submitted an application to City Council recommending that Loop 375 Transmountain West Hike and Bike Trail on the north side, from Resler to Paseo del Norte, be named the Elizabeth F. Hernandez Memorial Hike and Bike Trail; and
WHEREAS, City Council desires to accept the recommendation that Loop 375 Transmountain West Hike and Bike Trail on the north side, from Resler to Paseo del Norte, be named the Elizabeth F. Hernandez Memorial Hike and Bike Trail.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
That the City Council accept the recommendation of Representative Ann Lilly to name Loop 375 Transmountain West Hike and Bike Trail, on the north side, from Resler to Paseo del Norte, the Elizabeth F. Hernandez Memorial Hike and Bike Trail and authorize the City Manager to forward this resolution to the Texas Department of Transportation for approval of the name and execute any necessary documents to effectuate the adoption of the name and make any budget transfers necessary to carry out the intent of this resolution.
