The City Council met in regular session at the above place and date.  Meeting was called to order at 8:03 a.m.  Mayor Oscar Leeser present and presiding and the following Council Members answered roll call:  Peter Svarzbein, Michiel Noe, Claudia Ordaz, and Lilia Limón.  Late arrivals: Emma Acosta at 8:06 a.m., Cortney Niland at 8:08 a.m., and Carl L.             WHEREAS, railcars carrying hazardous material can pose a serious threat to first responders, civilians and the environment in the El Paso – Ciudad Juárez – Doña Ana County, New Mexico region; and

            WHEREAS, since 2010, the City of El Paso Fire Department has responded to over 250 rail incidents, including hazardous conditions; and

            WHEREAS, a Midland Kit is used in mitigating leaks in hazardous railcar valves and fittings and is a key tool for local jurisdictions responding to railcar emergencies; and  

            WHEREAS, on August 18, 2015, the City entered into a Technical Assistance Agreement with the Border Environment Cooperation Commission (“BECC”) in support of the project entitled “Hazardous Railcar Leak Mitigation Training for communities in Dona Ana County, NM/El Paso, TX/Juarez, Chih.” in order for the City of El Paso to purchase a Midland Kit for itself, one for Doña Ana County, NM and one for Ciudad Juárez, and in order to conduct trainings on how to use said equipment; and

            WHEREAS, the City has conducted the training pursuant to the Technical Assistant Agreement funding provided by the BECC; and

            WHEREAS, the City of El Paso has acquired such kits and wishes to provide one to Ciudad Juárez, pursuant to an International Cooperation Agreement.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

      THAT the Mayor be authorized to sign an International Cooperation Agreement between the City of El Paso, Texas and Ciudad Juárez, Chihuahua to provide to Ciudad Juárez a “Midland Kit” which was purchased through funding provided by the Border Environment Cooperation Commission (“BECC”) in support of the project entitled “Hazardous Railcar Leak Mitigation Training for communities in Dona Ana County, NM/El Paso, TX/Juarez, Chih.”.

*Motion made, seconded, and unanimously carried to DELETE a Resolution authorizing the Purchasing & Strategic Sourcing Director to notify Total Cleaning Services, that the City is terminating Contract No. 2015-1159 - Fire Facilities (4 Buildings) and NW Corral for default effective April 19, 2016, pursuant to the provisions and requirements of Section C, Paragraph 8B of the Contract Clauses, due to contractor’s failure to provide the required performance bonds.

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

139 Locust St, more particularly described as Lot 4 & N 3 FT OF 3 & S 22 FT OF 5, Block 6Orchard Park Subdivision, City of El Paso, El Paso County, Texas, PID #O263-999-0060-0900

to be $383.35, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 23rd day of October, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED EIGHTY THREE AND 35/100 DOLLARS ($383.35) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

WHEREAS, on November 10, 2015, City Council authorized the City Manager to execute an Agreement between the City of El Paso (“City”) and the El Paso Diabetes Association (“Event Sponsor”), to provide financial support for a portion of costs related to traffic control and public safety related to the Chile Pepper Bicycle Challenge, and

WHEREAS, the Chile Pepper Bicycle Challenge was rerouted primarily outside of City limits due to construction, and  therefore the Event Sponsor was unable to utilize City support granted to it by the City Council; and

WHEREASthe Event Sponsor  will now host the Diabetes Walk/Run in Downtown El Paso on April 24, 2016; and

WHEREAS, the Event Sponsor has presented and justified the municipal purpose to be served through the conduct of the Diabetes Walk/Run, and the City has found that the Diabetes Walk/Run serves an important public purpose and provides a benefit to the City and its citizens; and

WHEREAS, funding originally intended for the Chile Pepper Bicycle Challenge is still available to be reallocated to the Diabetes Walk/Run hosted by the Event Sponsor.

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Manager be authorized to execute an Agreement between the City of El Paso and the Event Sponsor for the Diabetes Walk/Run, as the support of the City constitutes an important public purpose for the benefit of providing recreational, health and community benefits to the City and its Citizens as described within the application; and under the terms of such Agreement, the City will provide support by covering certain traffic control, public safety and cleanup costs, and authorizing budget transfers to the appropriate City departments. The amount of funds provided shall be reallocated from those funds originally intended for the Chile Pepper Bicycle Challenge; reallocation of funds as described herein shall not cause an increase in the total funding allocated in the 2016 Fiscal Year budget for the purpose of providing City financial support to qualifying Events that fulfill a public purpose.

            WHEREAS, the City desires to award a new contract for the lease of unmarked police vehicles as a result of the issuance of a bid; and

            WHEREAS, the Mayor and City Council accept the recommendation from the Parks and Recreation Advisory Board to rename the Tierra Del Este Park #62 located at 14341 English Point Avenue within the City of El Paso, El Paso County Texas, as further described in “Attachment A”, as OFFICER ADRIAN ARELLANO PARK

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            THAT the Park, located at 14341 English Point Avenue located within the City of El Paso, El Paso County, Texas, as further described in Attachment “A”, shall henceforth be renamed and known as OFFICER ADRIAN ARELLANO PARK; and,

THAT Dr. Michiel R. Noe (“Applicant”) shall incur the customary costs associated with the renaming of a park, such as installing or replacing signs with the park name or any other signs posted or affixed to a facility.  Any proposed signs shall be acceptable to both the Parks and Recreation Department and Applicant.  (District 5)

            That the City Attorney be authorized to amend the Letter of Engagement with Ross Fischer of The Gober Group, PLLC to authorize Mr. Fischer to continue serving as the legal support to the City’s Ethics Review Commission and to finalize the investigation of the actions by City staff, elected officials and vendors which led up to the solicitation of a new financial advisor for the City of El Paso commencing in 2013 through 2015.
