A RESOLUTION OF THE CITY Council OF EL PASO NOMINATING HUNT COMPANIES, INC. TO THE OFFICE OF THE GOVERNOR ECONOMIC DEVELOPMENT AND TOURISM (“OOGEDT”) THROUGH THE ECONOMIC DEVELOPMENT BANK (“BANK”) FOR DESIGNATION AS A QUALIFIED BUSINESS AND ENTERPRISE PROJECT (“PROJECT”) UNDER THE TEXAS ENTERPRISE ZONE PROGRAM UNDER THE TEXAS ENTERPRISE ZONE ACT, CHAPTER 2303, TEXAS GOVERNMENT CODE (“ACT”).

 

            WHEREAS, the City Council of the City of El Paso (‘City”) has previously passed Ordinance No. 017116 on May 26, 2009, electing to participate in the Texas Enterprise Zone Program, and the local incentives offered under this Resolution are the same on this date as were outlined in Ordinance No. 017116; and

 

            WHEREAS, pursuant to Chapter 2303, Subchapter F of the Texas Enterprise Zone Act, Texas Government Code (“Act”), Hunt Companies, Inc. has applied to the City for designation as an enterprise zone project; and

 

            WHEREAS, the Office of the Governor Economic Development and Tourism (“OOGEDT”) through the Economic Development Bank (“Bank”) will consider Hunt Companies, Inc. as an enterprise project pursuant to a nomination and an application made by the City; and

 

            WHEREAS, the City desires to pursue the creation of the proper economic and social environment in order to induce the investment of private resources in productive business enterprises located in the city and to provide employment to residents of enterprise zones, veterans and to other economically disadvantaged individuals; and

 

            WHEREAS, this Resolution will reflect the determination, according to the OOGEDT’s online mapping tool, that Hunt Companies, Inc. is located inside an enterprise zone; and

 

            WHEREAS, the City finds that Hunt Companies, Inc. meets the criteria for Designation as an enterprise project under Chapter 2303, Subchapter F of the Act on the following grounds:

           

            1.         Hunt Companies, Inc. is a "qualified business" under Section 2303.402 of the Act since it will be engaged in the active conduct of a trade or business at a qualified business site located inside an enterprise zone and at least twenty-five percent (25%) of the business' new employees will be residents of an enterprise zone or economically disadvantaged individual; and

 

            2.         There has been and will continue to be a high level of cooperation between public, private, and neighborhood entities within the area; and

 

            3.         The designation of Hunt Companies, Inc. as an enterprise project will contribute significantly to the achievement of the plans of the City for development and revitalization of the area.

 

            WHEREAS, the City finds that Hunt Companies, Inc. meets the criteria for tax relief and other incentives adopted by the City and nominates Hunts Companies, Inc. for enterprise project status on the grounds that it will be located at the qualified business site, will create a higher level of employment, economic activity and stability; and

 

            WHEREAS, the City finds that it is in the best interest of the City to nominate Hunt Companies, Inc. as an enterprise project with Designation status pursuant to the Act.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

           

            1.         That Hunt Companies, Inc. is a "qualified business" as defined in Section 2303.402 of the Act, and meets the criteria for designation as an enterprise project, as set forth in Section 2303, Subchapter F of the Act;

 

            2.         That the enterprise zone project shall take effect on the date of designation of the enterprise project by the agency and terminate five years after date of designation; and

 

            3.         That the Director for Economic and International Development or her designee be authorized to sign any and all documents required by OOGEDT to complete the nomination process

            That the City Manager be authorized to sign a Southern Industrial Site Lease by and between the City of El Paso (“Lessor”) and Las Cruces 3Key, LLC (“Lessee”) for the premises described as follows:

 

A parcel of land being a portion of Morehouse Survey No. 12, a portion of Section 40, Block 80, TSP 2, Texas and Pacific Railway Company Surveys, and a portion of Lot 2, Block 1, Hawkins Plaza, El Paso County, Texas, containing approximately 90,200.722 square feet, and municipally known and numbered as 8836 Montana Avenue, El Paso, Texas.

            WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, MATA, PATRICIA T., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

 

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

 

1508 Cherokee Ridge Dr., more particularly described as Lot 8 (6751.00 Sq. Ft.), Block 47Ridge View Estates Unit 19 Subdivision, City of El Paso, El Paso County, Texas, PID #R460-999-0470-0800

 

to be $261.84, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 3rd day of August, 2017, and approves the costs described herein.

           

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount TWO HUNDRED SIXTY ONE AND 84/100 DOLLARS ($261.84) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount ONE THOUSAND ONE HUNDRED FIFTY SIX AND 79/100 DOLLARS ($1,156.79) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            WHEREAS, Alameda Palms, LTD., (the "Owner") has applied for approval of a detailed site development plan which requires City Plan Commission and City Council approval.  The detailed site development plan is subject to the development standards in the C-3/sc (Commercial/special contract) District regulations and subject to the approved Detailed Site Development Plan signed by the Applicant, the City Manager and the Executive Secretary to the City Plan Commission.  A copy of this plan is attached hereto as Exhibit "B" and is incorporated herein by reference for all purposes; and,

 

            WHEREAS, a report was made by the staff to the City Plan Commission and a public hearing was held regarding such application;

2.    A copy of the approved detailed site development plan, signed by the Applicant, the City Manager and the Secretary of the City Plan Commission, is attached hereto, as Exhibit "B" and incorporated herein by reference.

            WHEREAS, the City Council adopted the Budget Resolution for FY2018 on August 15th, 2017; and

 

            WHEREAS, paragraph 49 of the Budget Resolution provides that revisions or additions to the fees set forth in Schedule C, attached to the Budget Resolution, may be approved by simple resolution of the City Council; and

 

            WHEREAS, City Council approved funding for the University Pedestrian Improvement Program which allowed for the redesign of Cincinnati Avenue between N. Mesa Street and N. Stanton Street (the “Cincinnati Commercial District”) to install wider sidewalks, street lighting, street trees, and parking meters; and

 

            WHEREAS, the construction of sidewalk cafés in the public right-of-way adjacent to businesses located on Cincinnati Street between N. Mesa Street and N. Stanton, within the Cincinnati Commercial District has been added to the University Pedestrian Improvement Program’s scope of work; and

 

            WHEREAS, area businesses wishing to use the sidewalk café adjacent to their business have agreed to offset the additional cost of the fencing for the sidewalk cafés; and

 

            WHEREAS, pursuant to Section 15.08.120 of the El Paso City Code, use of a sidewalk café on the City’s public right-of-way by the adjacent business owner requires a special privilege permit; and

 

            WHEREAS, City staff has studied the existing annual fee for a sidewalk café special privilege permit and the additional cost of the fencing for the sidewalk cafés to be constructed within the Cincinnati Commercial District; and

 

            WHEREAS, after receiving and reviewing the analysis, the City Council finds that the recommended annual fee for use of the sidewalk cafés constructed by the City within the Cincinnati Commercial District, is reasonable and necessary to allow the use of the City’s public right-of-way and to offset the cost and maintenance of the fencing for the sidewalk cafés.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO:

 

That Schedule C, attached to the FY 2018 Budget Resolution and effective September 1st, 2017, shall be amended effective May 1st, 2018, as set forth in Attachment A, to specify the revised fee associated with the use of the sidewalk cafés within the Cincinnati Commercial District and associated with Title 15 (Public Services), Chapter 15.08 (Street Rentals), Section 15.08.120 (Special Privilege Licenses and Permits) of the El Paso City Code.
