The City Council met in regular session at the above place and date.  Meeting was called to order at 8:06 a.m.  Mayor Oscar Leeser present and presiding and the following Council Members answered roll call: Jim Tolbert, Carl L. Robinson, Michiel R.             WHEREAS, pursuant to the provisions of the Texas Revised Civil Statutes Article 4413(37) and Texas Administrative Code Title 43; Part 3; Chapter 57 the City of El Paso is eligible to receive grant funding from the Texas Department of Motor Vehicles through the Automobile Burglary and Theft Prevention Authority (ABTPA) grant program to support the Police Department Auto Theft Task Force for automobile theft enforcement teams and to combat automobile burglary in El Paso; and

            WHEREAS, the El Paso City Council finds that the ABTPA FY2018 grant program is beneficial to the community and will assist the City of El Paso to combat automobile burglary and theft.

            WHEREAS, the El Paso City Council agrees that in the event of loss or misuse of the ABTPA grant funds, the City of El Paso assures that the grant funds will be returned in full to ABTPA; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

  1. That the City Manager, or designee, be authorized to submit an Automobile Burglary and Theft Prevention Authority FY2018 grant application and to alter, decline, modify, terminate and/or execute all necessary documents related to the grant; 
  2. That the El Paso Police Department Auto Theft Task Force Lieutenant, or designee, is designated as the Program Director; and
  3. That the City of El Paso’s Chief Financial Officer, or designee, is designated as the Financial Officer for this grant.

*R E S O L U T I O N

 

            WHEREAS, the City Council adopted the Budget Resolution for FY 2017 on August 23, 2016; and

WHEREAS, paragraph 48 of the Budget Resolution provides that revisions or additions to the fees set forth in Schedule C, attached to the Budget Resolution, may be approved by simple resolution of the City Council; and

WHEREAS, the City Council desires to establish the amount of fees and related charges made necessary and authorized by the revisions to Title 9 of the City Code relating to the social host accountability ordinance civil penalties.

            NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO:

            That Schedule C, attached to the FY 2017 Budget Resolution and effective September 1, 2016, shall be amended, effective upon signature of this resolution by the Mayor, as set forth in Attachment A, to establish the amounts of fees and related charges made necessary and authorized by the revisions to Title 9 of the City Code relating to the social host accountability ordinance civil penalties.

            WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, AGUILAR, BERNARDA C., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

to be $347.77, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 21st day of November, 2016, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED FORTY SEVEN AND 77/100 DOLLARS ($347.77) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            3.         The City Clerk is directed to give notice of the lien by filing a copy of this Resolution for record with the County Clerk.

RESOLUTION ACCEPTING PETITION FOR AND CALLING FOR A PUBLIC HEARING ON THE CREATION OF PUBLIC IMPROVEMENT DISTRICT NO. 2 THE EASTSIDE SPORTS COMPLEX WITHIN THE CITY OF EL PASO PURSUANT TO CHAPTER 372 TEXAS LOCAL GOVERNMENT CODE AND AUTHORIZING THE MAILING AND PUBLICATION OF NOTICE OF THE PUBLIC HEARING

 

WHEREAS, the City of El Paso, Texas (the “City”) has received a petition (the “Petition”) requesting creation of a public improvement district (the “PID”) under Chapter 372 of the Texas Local Government Code (the Act), from the record owner of taxable real property representing more than fifty percent (50%) of the appraised value of the real property liable for assessment (as determined by the most recent certified appraisal roll for El Paso County) in the proposed PID and the record owner of taxable real property that constitutes more than 50% of all of the area of all taxable real property that is liable for assessment under the proposal; and

 

WHEREAS, the Petition, a copy of which is attached hereto as Exhibit A, has been examined, verified, and found to meet the requirements of Section 372.005(b) of the Act and to be sufficient for consideration by the City Council; and

 

WHEREAS, the boundaries of the proposed PID are described in the attachment to the Petition and shown on the map attached hereto as Exhibit B, said area for the PID being within the boundaries of the City ; and

 

WHEREAS, the City Council accepts the Petition and desires to schedule a public hearing to consider the creation of the PID to finance the design, development, construction, improvement, and maintenance of the Eastside Sports Complex as well as other public amenities and the payment of expenses incurred in the establishment, administration, and operation of the District, including costs of issuing bonds and funding debt service and capitalized interest reserves; these Authorized Improvements shall promote the interests of the City and confer a special benefit upon the Property.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO, TEXAS:

 

Section 1: THAT a public hearing is hereby scheduled at 8:00 a.m., on May 30, 2017at City Hall, at 300 N. Campbell, El Paso, Texas 79901 to receive public comment on the creation of the PID in the area described in the petition attached as Exhibit A and as shown on the map in Exhibit B, pursuant to the Act; and

 

Section 2: THAT notice of said hearing, in the substantially final form presented herewith in Exhibit C with such changes as may be approved by the City’s counsel, shall be published in a newspaper of general circulation in the City before the 15th day prior to the hearing as required by the Act; and
