Meeting was called to order at 8:01 a.m. Mayor Oscar Leeser present and presiding and the following Council Members answered roll call: Ann Morgan Lilly, Larry Romero, Emma Acosta, Carl Robinson, Michiel R. Noe, and Lilia Limón. *R E S O L U T I O N WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, ITTLESON TEXAS BUILDING LLC, referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices. The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as: 131 Mc Clintock Drive, more particularly described as ELY PT OF Lot 3 (268.23 ON N 274.13 ON E 262.9 ON ST 324.29 ON W) (77477.76), Block 3, Boykin Commercial District #4 Subdivision, City of El Paso, El Paso County, Texas, PID #B695-999-0030-0300 to be $606.07, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007. The City Council finds that the work was completed on the 21st day of October, 2014, and approves the costs described herein. 2. The City Council finds that the work was completed on the 15th day of September, 2014, and approves the costs described herein. 2. The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED SEVENTY SEVEN AND 54/100 DOLLARS ($377.54) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum. 3. The City Council finds that the work was completed on the 24th day of October, 2014, and approves the costs described herein. 2. The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED THIRTY NINE AND 24/100 DOLLARS ($339.24) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum. 3. *R E S O L U T I O N WHEREAS, Splendid Sun Productions, LLC, (hereinafter referred to as “Grantee”) has submitted an application for a Special Privilege Permit pursuant to Title 15.08.120 (D) of the El Paso City Code, for the use and closure of rights-of-way within the City of El Paso’s (hereinafter referred to as “the City”) for the Neon Desert Music Festival from 12:00 p.m. on Friday, May 22, 2015 to 10:00 p.m. on Monday, May 25, 2015 (hereinafter referred to as “Event”); and WHEREAS, The City has found the Event serves a public purpose; and WHEREAS, The State of Texas (hereinafter referred to as the “State”) owns and operates a system of highways for public use and benefit, including North Mesa Street (SH 20) within El Paso, Texas; and WHEREAS, The Event will utilize both City and State rights-of-way: and WHEREAS, 43 TAC, Section 22.12 establishes the rules and procedures for the temporary closure of portions of the State Highway System for periods of time exceeding four hours; and WHEREAS, the State in recognition of the public purpose for the Event, provides a means of cooperating with the City for the temporary closure of State right-of-way, provided the closure is in accordance with the requirements of 43 TAC, Section 22.12 and the City enters into an Agreement for the Temporary Closure of State Right-of-Way for the Event (Form TEA 30A). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO: That the closure of rights-of-way within the City of El Paso for the Neon Desert Music Festival from 12:00 p.m. on Friday, May 22, 2015 to 10:00 p.m. on Monday, May 25, 2015 serves the public purpose of providing cultural and recreational activities for the residents and visitors of the City of El Paso, and in accordance with 43 TAC, Section 22.12, the City Manager is authorized to sign an Agreement For The Temporary Closure of State Right Of Way (Form TEA 30A) by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the temporary closure and use of State owned and operated street(s) in excess of four hours for portions of North Mesa Street (SH 20), and the companion Agreement between the City of El Paso and Splendid Sun Productions, LLC (“Grantee”) for the Event, whereby Grantee shall assume responsibilities for the event upon the issuance of required permits from the City of El Paso and substantial conformity to the finalized TEA30 agreement between the City of El Paso and State of Texas Department of Transportation. |

R E S O L U T I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO: That the Mayor be authorized to sign an Interlocal Agreement between the City of El Paso and El Paso County, Texas on behalf of the El Paso County Sheriff’s Office, Center for Hope - Program of the El Paso Center for Children, El Paso County District Attorney’s Office, County Attorney’s Office, El Paso County Mental Health Support Services, United States Attorney’s Office, Federal Bureau of Investigation, United States Department of Homeland Security, US Department of Labor - Wage and Hour Division, Texas State Attorney General’s Office, Texas Department of Public Safety and the Texas Department of Child Protective Services to form a collaborative among local and federal law enforcement, prosecutors and victim service providers to provide comprehensive services and respond effectively to combat human trafficking and to collectively apply for a $900,000.00 human trafficking grant from the United States Department of Justice, Office of Justice Programs and Office for Victims of Crime from the Bureau of Justice Assistance. The City of El Paso will provide in-kind personnel, related equipment use and fringe benefits with all expenses reimbursed to the City. There is no cash match from the City of El Paso.

R E S O L U T I O N WHEREAS, on November 6, 2012, the voters of the City of El Paso, Texas approved the issuance of general obligation bonds for the purposes of constructing new and improved amenities for parks and recreation facilities, open space improvements, libraries, museums, the Zoo, neighborhood improvements, and cultural and performing arts facilities; WHEREAS, on December 18, 2012, the City Council approved a resolution based upon a finding that it is in the best interest of the citizens of El Paso to establish a Bond Overview Advisory Committee to review the progress of the 2012 Bond Issue Projects and to provide oversight and feedback to City staff with regard to project expenditures and implementation; and WHEREAS, on February 24, 2015, the City Council amended the Resolution establishing the 2012 Bond Overview Advisory Committee to create a subcommittee of the Bond Overview Advisory Committee to advise the City Council and the Bond Overview Advisory Committee on matters related to the Hispanic Cultural Center, and WHEREAS, the City Council would like to further amend the December 18, 2012 Resolution and the February 24, 2015 Resolution to expand the duties of the Hispanic Cultural Center Subcommittee. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO: 1. That the February 24, 2015 Resolution which established the Hispanic Cultural Center Subcommittee is hereby amended as follows: Paragraph C. Duties, is amended to read as follows: C. Duties - The Hispanic Cultural Center Subcommittee shall assist with the development of the Hispanic Cultural Center by advising the City Council and BOAC on the following: 1. R E S O L U T I O N A RESOLUTION ESTABLISHING A VETERANS AFFAIRS ADVISORY COMMITTEE FOR THE PURPOSE OF ADVISING THE CITY OF EL PASO ON MATTERS RELATED TO PROVIDING ASSISTANCE TO VETERANS.
WHEREAS, the City of El Paso is home to the Ft. Bliss military installation and has a large military veteran population; and
WHEREAS, the City of El Paso seeks to create a network that provides military veterans with assistance in the area of transportation.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
That the Veterans Affairs Advisory Committee is hereby established to advise the City Council on matters related to veterans as follows:
1. Committee Established – Membership
A. The Veterans Affairs Advisory Committee (VAAC) shall consist of nine members appointed by the Mayor and each City Council Representative. The persons appointed to this Committee shall either be veterans of the United States Armed Forces or the spouses or domestic partners of a veteran and should have an interest in improving the everyday life of our military veterans.
B. The El Paso County Veteran’s Affairs Coordinator shall be an ex-officio member of the Committee and serve in an advisory capacity to the Committee.
C. The city manager shall designate a city department to provide an employee to serve as the recording secretary and shall provide administrative and technical staff support to the Committee.
2. Terms
A. Each member of the City Council shall nominate one member to the Veterans Affairs Advisory Committee. The terms of office shall be for two years. Appointments to vacancies that occur other than by expiration of a member's term of office shall be filled by appointment by the Mayor and City Council for the remainder of the unexpired term. Members shall not serve more than two consecutive terms.
B. The Veterans Affairs Advisory Committee shall annually select from among its appointed members a chair and a vice-chair. The Committee shall adopt such rules and regulations for the government of its proceedings as may be deemed proper, not inconsistent with the ordinances and the Charter of the City and the laws of the State of Texas.
C. A quorum of the Veterans Affairs Advisory Committee shall be a majority of the total number of the members who have been appointed by City Council at the time of the meeting; provided however that a quorum shall not be less than five. The chair shall have a vote in all matters. No final action shall be taken on any matter except pursuant to a simple majority vote of members present.
3. Duties - The Veterans Affairs Advisory Committee shall perform the following :
A. Serve as a source of information related to the status, resources and services available within the El Paso community to the City's large veteran population.
B. Identify and review the entire range of services currently available to veterans and recommend ways to strengthen such services, to include the promotion of collaboration among Service Providers.
C. Evaluate and recommend programs, policies and practices designed to alleviate veterans' difficulties in meeting basic needs related to transportation, housing, employment and other areas affecting veterans in the city.
D. Stimulate awareness among the public and private sector of veterans' full potential and of the importance of veterans' contributions to the sustainability and development of our community.
E. Report status of activities to City Council on a semi-annual basis.

HB 1535 (551.071) R E S O L U T I O N WHEREAS, the Texas Legislature is currently considering the passage of H.B. 1535 (Non-ERCOT Bill) which is being championed by electric utilities from across the State of Texas; WHEREAS, H.B. 1535 creates a regulatory mechanism to allow utilities to impose rate increases on customers through relation back of rates to a date earlier than the final order of the regulatory authority limiting the increasing costs to customers and limiting oversight of the primary regulatory body, the El Paso City Council; WHEREAS, in recognition of the fact El Paso Electric Company operates as a monopoly, has a service area which includes the State of New Mexico and the majority of the service area within the State of Texas is within the El Paso city limits, the Mayor and Council asked El Paso Electric Company to exclude itself from H.B. 1535; WHEREAS, El Paso Electric Company has not only refused to do so, it has lobbied the Texas Legislature for passage of H.B. 1535 and for El Paso Electric Company to be included; WHEREAS, the El Paso City Council approved a Resolution on March 17, 2015 expressing opposition to H.B. 1535 and requesting that members of the El Paso Delegation to the State legislature seek to have El Paso Electric Company excluded from the bill; WHEREAS, during the legislative process, H.B. 1535 has been amended and the City Council has been repeatedly asked to remove its objection to the bill and to consent to El Paso Electric Company’s inclusion in the bill; and WHEREAS, the El Paso City Council desires to formally state its position with regard to the bill. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO AS FOLLOWS: 1. The City of El Paso continues to oppose the passage of H.B. 1535 if El Paso Electric Company is part of the bill for the following reasons: ·The bill will increase costs to El Paso ratepayers. ·There is no benefit to the El Paso ratepayers. ·El Paso Electric Company has refused to amend the bill to allow its application to be limited to prospective and not affect the Montana Power Plant. ·El Paso Electric Company will file a rate case in July-August including Montana Units 1 and 2. ·Under current law, the case cannot include Montana Units 3 and 4. ·If H.B. 1535 is approved by the legislature including El Paso Electric Company the case could be adjusted to start charging El Paso ratepayers for one or both of Montana units 3 and 4. ·At $87 million per unit, the rate impact per unit could be as much as $10-$13 million in Texas resulting in higher utility rates for Texas rate payers. 2. The State of New Mexico does not permit either relation back of rates or reaching forward to include rates for Power Plants completed a year after the test year in the case. Because El Paso competes with southern New Mexico for job creation and economic development prospects we will be at a competitive disadvantage. 3. The City of El Paso has been an effective regulator and has managed to maintain equitable rates for the citizens and El Paso Electric Company. Under the current law El Paso Electric Company has prospered and enjoyed decent earnings and reasonable bond ratings.

Motion made by Mayor Pro Tempore Niland, seconded by Representative Romero, and unanimously carried that the CITY OF EL PASO authorizes the City Attorney to file a Motion in Intervention and if necessary request a hearing in the following Public Utility Commission Docket No. 44677 Application of El Paso Electric Company for Approval to Revise its Energy Efficiency Cost Recovery Factor and Request to Establish Revised Cost Cap. This Motion is intended to grant broad authority to the City Attorney to take any action necessary to address these matters in consultation with the City Manager. This authorization also authorizes the City Attorney to retain outside Counsel and any necessary consultants in connection with this matter. NOT PRESENT FOR THE VOTE: Representative Limón |
