BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

WHEREAS, El Paso Sun City Pride Organization (hereinafter referred to as “Grantee”) is producing El Paso Sun City Pridefest to be open to the public from 4:00 p.m. Saturday, June 6, 2015 to 2:00 a.m. Sunday, June 7, 2015 (hereinafter referred to as “Event”); and

WHEREAS, the Grantee has submitted an application for a Special Privilege Permit pursuant to Title 15.08.120 (D) of the El Paso Municipal Code, for the use and closure of portions of City rights-of-way on East Franklin Avenue between North Santa Fe Street and North Oregon Street and North El Paso Street between East Franklin Avenue and the driveway at 201 West Main Drive in conjunction with the Event; and

WHEREAS, the Grantee has indicated their intent to authorize the Pride Lounge, LLC, (hereinafter referred as “TABC Permittee”) to provide for the temporary sale and service of alcoholic beverages within the identified closed portions of City rights-of-way during the Event; and

WHEREAS, the Texas Alcoholic Beverage Commission (TABC) requires that the City Council for the City of El Paso approve, as a permissible activity, the sale and service of alcoholic beverages within  City rights-of-way, prior to issuance of such permit; and

WHEREAS, the Grantee assumes full responsibility for the TABC Permittee, including verification that the Permittee has obtained a permit for the temporary sale and service of alcoholic beverages from the TABC prior to the Event.

            NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            That the temporary sale and service of alcoholic beverages by Pride Lounge, LLC, in the closed portions of City rights-of-way on East Franklin Avenue between North Santa Fe Street and North Oregon Street and North El Paso Street between East Franklin Avenue and the driveway at 201 West Main Drive from 4:00 p.m. Saturday, June 6, 2015 to 2:00 a.m. Sunday, June 7, 2015 is a permissible activity in conjunction with El Paso Sun City Pride Organization’s El Paso Sun City Pridefest, upon issuance of the required permits from the Texas Alcoholic Beverage Commission and the City of El Paso.

WHEREAS, the Grantee has submitted an application for a Special Privilege Permit pursuant to Title 15.08.120 (D) of the El Paso Municipal Code, for the use and closure of portions of City rights-of-way on Anthony Street between West San Francisco Avenue and West San Antonio Avenue, Western Street between Anthony Street and Durango Street Service Road, and the walkway connecting West San Antonio Avenue and Western Street in conjunction with the Event; and

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

8820 Alameda Avenue, more particularly described as Lots 4-D (1.42 ACRES) & 4-D-1 (.11 ACRE) & 4-C-A (.27 ACRE) & 4-C-B (.16 AC) (1.9600 ACRES), Block 39Ysleta Subdivision, City of El Paso, El Paso County, Texas, PID #Y805-999-039B-0401

to be $540.72, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 12th day of November, 2014, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount FIVE HUNDRED FORTY AND 72/100 DOLLARS ($540.72) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED THIRTY AND 58/100 DOLLARS ($330.58) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount FOUR HUNDRED NINE AND 74/100 DOLLARS ($409.74) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

to be $321.10, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 14th day of November, 2014, and approves the costs described herein.

            WHEREAS, the City desires to amend the Agreement for UTA to provide Lean Six Sigma Yellow Belt training; and

            WHEREAS, UTA is an institution of higher education that that has the capability and is willing to provide the City with additional training.

R E S O L U T I O N

            WHEREAS, the Colorado Health Facilities Authority (the "Authority") is in the process of issuing its Health Facilities Revenue Bonds (The Evangelical Lutheran Good Samaritan Society Project), Series 2015((the "Bonds"), a portion of which will be used to finance the Evangelical Lutheran Good Samaritan Society—Facilities located in El Paso, Texas (the “Project”);

 

            WHEREAS, the City of El Paso has conducted and held a public hearing regarding issuance of the Bonds and the Project on June 2, 2015 at the Council meeting starting at 8:00 A.M. pursuant to the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended;

 

            WHEREAS, the City approves and encourages the Authority in its efforts to accomplish the issuance of the Bonds and, as part of such transaction, is willing to provide a Certificate For Resolution and Certificate Of Public Hearing concerning the conduct of the Public Hearing June 2, 2015, copies of which are both attached hereto as Exhibits to this Resolution and made a part hereof for all purposes.

 

            NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            1.         THAT the Preambles to this Resolution set forth above are incorporated herein and made part of this Resolution.

 

            2.         THAT the Mayor and the City Clerk of the City of El Paso and the other officers of the City are hereby authorized, jointly and severally, to execute and deliver such endorsements, instruments, certificates, documents, or papers necessary and advisable to carry out the intent and purposes of this Resolution and the issuance of the Bonds.
