That the City Manager be authorized to sign a Partial Release Agreement (“Agreement”) in substantial conformity with the Agreement posted with the City agenda by and between the City of El Paso through its El Paso International Airport and the United States of America, acting by and through the Federal Aviation Administration to release certain Restrictions related to allowed uses on an approximate 1,179.25 acre portion of the approximately 2,000 acre property granted to the City from the United States of America by the July 8, 1969 Indenture located in El Paso County, Texas. The Agreement must be approved as to form by the City Attorney or designee.

That the City Manager be authorized to administratively sign, on behalf of the City of El Paso, the following for each airline: 1) a Second Amendment to Airline Operating Agreement and Terminal Building Lease, and 2) a Second Amendment to Operating Agreement, in substantially the formats attached to this Resolution, to add two one-year extensions to each existing contract, upon review and approval “As to Form” by the City Attorney prior to execution.

WHEREAS, the City of El Paso (the “City”) is eligible to apply for grants through the Criminal Justice Division of the Office of the Governor of the State of Texas (“CJD”); and

WHEREAS, the El Paso City Council seeks to receive grant funding through the CJD grant/application number 4157701 for the El Paso Police Department project identified as “Coronavirus Emergency Supplemental Funding (CESF) Program, FY2020” and

WHEREAS, the El Paso City Council designates the City Manager or his designee as the City’s authorized official.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

1. THAT, the El Paso City Council authorizes the submission of the Office of the Governor of the State of Texas, Criminal Justice Division, grant application number 4157701, for the City of El Paso Police Department project identified as “Coronavirus Emergency Supplemental Funding (CESF) Program, FY2020” to provide financial assistance to the City of El Paso.

2. THAT, the City of El Paso shall provide all applicable matching funds for said grant if applicable;

3. THAT, the City Manager or designee is authorized to apply for, accept, reject, alter and/or terminate said grant; and

4. THAT, the City Council agrees that in the event of loss or misuse of said grant funds, the City of El Paso will return all funds for said grant to the State of Texas Office of the Governor, Criminal Justice Division.

5. BE IT FURTHER RESOLVED THAT, the City Manager or designee is authorized to sign any related paperwork, including but not limited to, the actual grant contract, the authorization of budget transfers, and/or revisions to the operation plan, as well as any grant amendments, corrections or extensions of the grant agreement which increase, decrease or de-obligate program funds, provided that no additional City funds are required.

WHEREAS, on March 13, 2020 the President of the United States declared a national emergency, the Governor of the State of Texas declared a state of disaster, and the Mayor of the City of El Paso (“City”) declared a local state of disaster in relation to COVID-19; and

WHEREAS, on March 17, 2020 City Council issued an Emergency Ordinance Instituting Emergency Measures Due to A Public Health Emergency (“Emergency Ordinance”); and

WHEREAS, some local businesses were ordered to cease operations due to national and local regulations related to the COVID-19 pandemic, causing a large number of lay-offs and economic strain for the City and its residents and businesses; and

WHEREAS, on March 27, 2020, the federal government enacted the Coronavirus Aid, Relief and Economic Security Act (“CARES Act”), which established the Coronavirus Relief Fund and appropriated $150 billion to the Fund to be used to address the economic fallout caused by the COVID-19 pandemic; and

WHEREAS, the City is a recipient of the Coronavirus Relief Fund under the CARES Act grant; and

WHEREAS, on May 12, 2020 the City Council appropriated the Coronavirus Relief Fund grant funds to be used by the City in accordance with the requirements stipulated by the CARES Act and federal guidelines; and

WHEREAS, the City desires to enter into a Subrecipient Agreement with Liftfund, whereby Liftfund will administer CARES Act funds as grants to small businesses that have experienced revenue loss due to business interruptions caused by closures resulting from the COVID-19 pandemic; and

WHEREAS, the City’s expenditure under this Agreement is, in the reasonable judgement of the City Council, a necessary expenditure incurred due to the public health emergency with respect to COVID–19, which was not accounted for in the budget most recently approved as of the date of enactment of this section for the City, and will be incurred during the period that begins on March 1, 2020, and ends on December 30, 2020; and

WHEREAS, the City’s expenditure under this Subrecipient Agreement is related to the provision of grants to reimburse small businesses for the costs of business interruptions caused by required COVID-19 closures.

WHEREAS, on March 13, 2020, the Governor of the State of Texas declared a state of disaster, the President of the United States of America declared a national emergency, and the Mayor of the City of El Paso declared a local state of disaster pursuant to Texas Government Code Section 418.108; and

WHEREAS, the City of El Paso Department of Public Health Authority issued various COVID-19 Prevention Orders in an effort to mitigate and slow down the spread of disease in El Paso County; and

WHEREAS, pursuant to Texas Code Section 418.1015(a) and Chapter 2.48.010 of the El Paso City Code, the Mayor serves as the office of emergency management director for the City of El Paso (the “City”); and

WHEREAS, as the result of State and Federal mandates, CDC guidelines and local Emergency Orders and the City’s significant FY202 budget shortfalls all Quality of Life facilities were closed to the public beginning in March 2020 in response to the COVID-19 Pandemic; and

WHEREAS, during the June 9, 2020 Special Work Session, City Council was presented with a phased plan showing some facilities and services being reactivated in early July 2020; and

WHEREAS, the City Manager, in compliance with Governor’s Executive Orders and corresponding Minimum Standard Health Protocols, may designate which and how parks and recreational areas and facilities, including City tennis courts, City basketball courts, public swimming pools, splash pads, the zoo, public museums and libraries will open.

NOW, THEREFORE, BE IT RESOLOVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Council directs the City Manager to work with staff on a plan including costs and benefits for reopening indoor quality of life facilities (including but not limited to libraries, community centers, recreation centers, and senior centers) that are located within low-income, HUD-designated Qualified Census Tracts (defined as those Census Tracts in which at least 50% of households have an income less than 60% of the area median gross income) at such time that it is determined by public health professionals to be acceptable to do so from a public health standpoint.

WHEREAS, under the Resolution, the El Paso Water Utilities Public Service Board Selection Committee reviews résumés submitted by persons interested in filling the vacant position and submits to the City Council the names and the ranking of three eligible candidates; and,

WHEREAS, a quorum of the El Paso Water Utilities Public Service Board Selection Committee met on June 11, 2020 pursuant to the Texas Open Meetings Act and approved the nomination, ranking and recommendation of eligible candidates for consideration and appointment by City Council.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO, TEXAS:

That, a quorum of the El Paso Water Utilities Public Service Board Selection Committee met on June 11, 2020 pursuant to the Texas Open Meetings Act and approved the nomination, ranking and recommendation to the City Council of the following candidate to fill a vacancy on the El Paso Water Utilities Public Service Board:

Ivonne Santiago, Ph.D.

That, the El Paso City Council hereby appoints Ivonne Santiago, Ph.D. to fill the vacancy on the El Paso Water Utilities Public Service Board for the Environmental or Health position. The term of appointment shall commence on July I, 2020 and shall be for a four (4) year term.

WHEREAS, the Valley View Neighborhood Association intends to file an application to rename Robert E. Lee Blvd. to Buffalo Soldier Blvd; and

WHEREAS, in accordance with applicable City Code requirements, the application will be processed by the Planning and Inspections Department, reviewed by the Development Coordinating Committee (" DCC"), and City Plan Commission ("CPC") with the latter submitting a recommendation to City Council; and

WHEREAS, State Board of Education Representative Georgina Cecilia Perez intends to donate $ l,500.00 towards the application and street sign replacement costs; and

WHEREAS, in a separate resolution of even date herewith, City Representative of District 3, Cassandra Hernandez, desires to contribute discretionary funds in an amount not to exceed $3,000.00 for the remaining costs of the street renaming application and street sign replacement.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Council accept the donation in the amount of $1,500.00 from State Board of Education Representative Georgina Cecilia Perez to rename Robert E. Lee Blvd. to Buffalo Soldier Blvd and to pay for the street renaming application.

Further, the City Council authorizes the expenditure of the funds as described above fu1t her, that the City Manager is authorized to effectuate any budget transfers necessary to ensure that the funds are properly expended for such purpose and is authorized to execute any related agreements, amendments to such agreements, and documents necessary to carry out the purpose of this Resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Council directs the City Manager to bring forward the application in accordance with the process as required by applicable City Code provisions related to street renaming, and declares that the expenditure of District 3 discretionary funds in an amount not to exceed $3,000.00 for the remaining costs not covered by any and all donations for the street sign replacement and application costs for street renaming by the Valley View Neighborhood Association of Robert E. Lee Blvd. to Buffalo Soldier Blvd. serves a municipal purpose by setting the standard for a safe and secure city , promoting the visual image of El Paso, enhancing El Paso 's quality of life, promoting transparent and consistent communication among all members of the community, and nurturing and promoting a healthy and sustainable community.

Further, the City Council authorizes the expenditure of the funds as described above. Further, that the City Manager is authorized to effectuate any budget transfers necessary to ensure that the funds are properly expended for such purpose and is authorized to execute any related agreements, amendments to such agreements, and documents necessary to carry out the purpose of this Resolution.

EL PASO STRONG RESOLUTION No.1

WHEREAS, the City of El Paso has taken many steps to reform the El Paso Police Department (EPPD), including but not limited to the recruitment and hiring of high-caliber and qualified applicants, the creation of civilian involved Discipline Review Board and the Shooting Review Team, instituting training for de-escalation techniques, adoption of training and policies on a duty to intervene, the creation of the Crisis Intervention Team, and the independent investigation of officer involved shootings and many other reforms; and

WHEREAS, the City of El Paso is committed to improving our long-lasting community policing model through the adoption of best-practice policies and procedures; and

WHEREAS, despite widespread support and efforts, there are still no national standards for police recruitment, training or use of force techniques; and

WHEREAS, racial discrimination in policies , services, and institutions continues to support a web of connected outcomes that disparately impact Black and Latino/a and other non-white communities of color, such as poverty, increased food insecurity, increased incarceration, decreased educational attainment, decreased economic mobility, shorter life expectancy, among others, which may last for generations, as well as fewer opportunities to remedy these outcomes and break the cycles that perpetuate them; and

WHEREAS, Black and Latino/a and other non-white communities most impacted by racial injustice must be heard and centered in the process of reform, they must not be the only ones to demand change; and

WHEREAS, In March of 2015 Police Foundation President Jim Bueerman provided written testimony to the President's Task Force on 21st Century Policing which stated:

''The Five Things about Effective and Democratic Policing" for the 21st Century are:

1. Be purposeful and value-based (as opposed to rule-based);

2. Focus on legitimate, fair and equitable policing practices (as derived from community perceptions);

3. Engage in evidence-based policing strategies;

4. Focus on the future (by using future-studies concepts and tools); and

5. Focus on the ''business" of policing (e.g. organizational development, utilizing emerging technologies, the cost of policing, etc.);'' and

WHEREAS, the City of El Paso is committed to improving and remedying problematic policies and practices "as they arise," by establishing strategic goals to guide future policy making; and

WHEREAS, such short and long- term reforms and remedies focused on building racial justice must consider the breadth of issues and interactive relationships between policy positions, extending not only into substantive reform, but also into budget and personnel decisions; and

WHEREAS, the City of El Paso will pass this resolution to develop tools for use in evaluating the policies and practices of each City department and their impact on equity, with a goal of informing the budgeting and policymaking processes to relieve racial and socioeconomic inequities; and

WHEREAS, the City of El Paso will pass this resolution, “El Paso Strong” to seek reporting on and to encourage the elimination of racial disparities in arrests and other law enforcement actions; and

WHEREAS, the City of El Paso will pass this resolution, which calls for various methods for reporting use of force and deadly force incidents, the percent of officers with a history of sustained use of force incidents, and the number of complaints; and

WHEREAS, the City of El Paso commits to take action on the repo1ts and analyses prepared by City staff, adopting applicable recommendations and reforming policy in pursuit of racial justice; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

1. The City Council directs the City Manager to provide a detailed update on the current status of the Police Department and lead a discussion at several future City Council Work Sessions; and

2. These updates should include implementation of best practices in policing in comparison to no less than five (5) cities of similar size and demographics, and/or the top ten (10) safest cities including tools for use in evaluating the policies and practices of each City department and their impact on equity, with a goal of informing the budgeting and policymaking processes to relieve racial and socioeconomic inequities; and

3. The City Council directs the City Manager to continue reporting on racial profiling to encourage the elimination of racial disparities in arrests and other law enforcement actions; and

4. The City Council directs the City Manager to utilize various methods for reporting use of force and deadly force incidents, the percent of officers with a history of sustained use of force incidents, the number of complaints; and

5. These updates should include recommendations on the implementation of best practices in policing, in comparison to no less than five (5) cities of similar size and demographics, and/or the top ten (10) safest cities, including progress on the dashboard of metrics and indicators, analysis of the alignment of strategies with policies implemented since the adoption of this resolution, and recommendations to prioritize strategies.

6. The City Council directs the City Manager to research and study best practices for the composition and scope of the El Paso Discipline Review Board and the Shooting Review Board. The City Manager is directed to work with the current composition of the Discipline Review Board and Shooting Review Board to implement strategies and provide quarterly updates. These strategies and goals should be vetted and reviewed by the Internal Affairs Division (IAD) and the Risk Management Section of the El Paso Police Department These divisions will also provide recommendations to develop strategies and policies that require comprehensive reporting and potential alternatives to use of force. Should this work require additional staffing, the use of new technology, or resources, the City Manager will return to the City Council with appropriate budget amendments in future Fiscal Year proposed budgets. The Discipline Review Board and the Shooting Review Board will provide recommendations to the Chief of Police for additional or different metrics, improvements on existing metrics and reporting, data collection methods, or other analytical improvements to maintain the highest quality and accuracy of the analysis of progress toward this goal Such recommendations may include, but are not limited to, reporting of race by those with whom EPPD officers interact as required by Federal and State law.
