BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
WHEREAS, Visit El Paso/Destination El Paso, the City of El Paso (the “City”) was selected to host the 2019 Triple A-Baseball All Star Game and Home Run Derby on July 7, 2019 through July 11, 2019; and
WHEREAS, the City desires to support the event by entering into a contract (“Event Support Contract”) with MountainStar Sports Group, LLC, d/b/a/ El Paso Stadium Operations Company (“EPSOC”) including a $35,000.00 site fee (“Site Fee”); event marketing and promotional expenses not to exceed $10,000.00, as determined by the City in its sole and absolute discretion (“Event Marketing and Promotion”); and other miscellaneous expenses not to exceed $10,000.00, as determined by the City in its sole and absolute discretion (“Miscellaneous Expenses”) to be paid to EPSOC.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
WHEREAS, since October 2018 the U.S. Southern Border has confronted an unprecedented number of migrants seeking asylum in the United States; and
WHEREAS, in light of the looming humanitarian crisis on the Southern Border, Mayor Dee Margo expressed the City’s concerns to then U.S. Department of Homeland Security (“DHS”) Secretary, Kirstjen Nielsen; and
WHEREAS, on January 2, 2019, Fire Chief Mario D’Agostino briefed City Council on the growing number of migrants arriving to the City and the resultant reliance on non-governmental organizations who were in need of food, money and volunteers to aid with migrant care; and
WHEREAS, in January 2019, 7,800 migrants arrived to the City of El Paso (the “City”), followed by 12,500 migrants in February; and
WHEREAS, on March 25, 2019, the City held a Special Meeting of City Council during which it found that in order to protect the public health, safety and welfare of migrants and City residents alike, the City Manager should be granted broad authority until April 29, 2019 to take all action necessary to commit, direct, and assign necessary personnel and resources to provide humanitarian relief to migrants released into the El Paso Community; and
WHEREAS, on March 25, 2019, the City Council of El Paso also directed the Mayor to notify El Paso’s federal delegation of the request and need for reimbursement of resources and expenses used in addressing the continual arrival of migrants and authorized the contribution of $20,000.00 dollars towards a volunteer coordinator through United Way; and
WHEREAS, after Council’s March 25, 2019 allocation, United Way secured substantial alternative funding for a volunteer coordinator who has worked to coordinate a strategic volunteer network to support with ongoing migrant needs; and
WHEREAS, despite continuous national media coverage of the need for federal assistance for the care of incoming migrants, the City of El Paso has yet to receive federal aid or reimbursement; and
WHEREAS, starting April 6, 2019, U.S. Customs and Border Protection (“CBP”) began closing the Bridge of the Americas cargo import lot on Saturdays due to staffing shortages related to the volume of asylum seekers and ongoing humanitarian crisis on the southwest border; and
WHEREAS, on April 15, 2019, the City Council of El Paso received a briefing on the impact that CBP staffing shortages and a reduced number of open lanes for cargo, personal vehicles and pedestrians is having on border crossings and increasing wait times; and
WHEREAS, on April 24, 2019, the Annunciation House, a local non-profit organization, opened its new hospitality site, Casa del Refugiado, with the hope of accommodating up to 500 migrants at a time which would help reduce the number of hospitality sites around the area; and
WHEREAS, on April 29, 2019, the City Council of El Paso found that the migrant issues it addressed on March 25, 2019 persisted, and therefore extended the City Manager’s broad authority to commit resources for the provision of humanitarian relief to migrants through June 25, 2019, and instructed the City Manager to inform the El Paso Congressional and State Delegation of its expenditures and requests for reimbursement of taxpayer resources; and
WHEREAS, as of April 30, 2019, CBP apprehended 460,295 people on the southern border, with family units and unaccompanied minors accounting for 64 percent of the apprehensions; and
WHEREAS, in April 2019, 18,804 migrants were released by federal authorities into the City of El Paso, followed by 21,903 migrants in May; and
WHEREAS, local shelters, including Casa del Refugiado, have now on multiple occasions been unable to temporarily house newly released migrants due to a lack of capacity; and
WHEREAS, other non-profit organizations that have generously provided meals and transportation to arriving migrants are advising that they will soon be financially unable to continue to provide the aid they had consistently provided; and
WHEREAS, the Annunciation House has emphasized a pressing need for support in transporting migrants from local hospitality sites to the local bus station or El Paso International Airport; and
WHEREAS, the City of El Paso is increasingly concerned by the release of mass groups of people without access to potable water, food, or shelter during the summer months, and the origination and spread of potential and actual disease among migrants and El Paso residents; and
WHEREAS, on May 18, 2019, the Acting Commissioner of U.S. Customs and Border Patrol (“CBP”) asked Congress to act to address this national emergency; and
WHEREAS, CBP apprehended over 2,200 migrants crossing into El Paso at an unestablished port of entry on Memorial Day; and
WHEREAS, approximately one quarter of all U.S. Border Patrol apprehensions along the southwest border have taken place in El Paso; and
WHEREAS, despite the area’s need for CBP agents, the federal government has relocated CBP agents away from El Paso’s international bridges to aid DHS in the processing of asylum seekers; and
WHEREAS, the City of El Paso is home to 4 of the 28 international ports of entry between Texas and Mexico which accounted for the ingress and egress of $77.3 billion worth of annual trade, 16.8 million personal vehicle crossings, 11.3 million pedestrian crossings, and 1.3 million commercial crossings during 2018; and
WHEREAS, continuously prolonged wait times on the international bridges risks a decline in the overall regional economy; and
WHEREAS, migrants continue to cross into El Paso or be released by federal authorities into the City while the resources and volunteers of local non-profit and faith based organizations are incessantly drained; and
WHEREAS, the federal government has yet to provide the infrastructure, resources or the local funding necessary for Southwest border communities to address an unyielding number of arriving migrant; and
WHEREAS, the City Council of El Paso desires allow the City Manager and/or designee to reallocate the funds originally to be transferred to United Way as deemed necessary by the City Manager and/or designee in the provision of care, food, shelter and transportation to locally arriving migrants, which may include the transfer of the $20,000.00 of City funds to a non-governmental organization that will assist with these humanitarian efforts.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF EL PASO:
(1) That the City Manager is granted broad authority until September 1, 2019, to take all action necessary to commit, direct, and assign necessary personnel and resources, including financial resources, to provide humanitarian relief to migrants released by federal authorities into the El Paso community; and
(2) That the City Manager and/or designee be authorized to establish funding sources and make any necessary budget transfers to provide a contribution of $20,000.00 dollars, to a non-governmental organization that will assist with the care, shelter, or transportation of migrants, and that upon the City Attorneys Office’s review and integration of sufficient controls, that the City Manager or designee be authorized to execute any and all necessary documents to transfer some or all of the funds; and
(3) That the City Manager and/or designee is directed to provide quarterly reports to City Council of the cost to tax payers for the City’s expenditures in providing relief for migrants; and
(4) That the Mayor is directed to continue to urge the City’s federal and state delegation of the need for local reimbursement and resources to address the continued migrant flow.

THAT the City finds that CitiMortgage, LLC showed a good cause to extend the deadline to apply for a refund of the overpayment of the 2013 taxes and the tax refund in the amount of $105.33 is approved.

WHEREAS, it is to the mutual benefit of the parties that First Light Federal Credit Union, make a loan to the Borrowers to refinance the existing mortgage into a fixed interest rate mortgage at a lower interest rate, with no cash-out to the Borrower from the transaction.

That the City Manager be authorized to sign a Service Agreement to perform Real Estate Management Services (Solicitation No. 2019-838R) by and between the City of El Paso (“City”) and CBRE, Inc., for a contract term of three (3) years from the date of this Agreement is approved by the City Council, with one (1) option to extend for one (1) additional year. The agreement is broken into two components, Item I-Brokerage Services and Item II-Consulting and Support Services. The Brokerage Services is based on commission that will be incurred on a task order basis for acquisitions and dispositions of real property or substantive leases. The Consulting and Support Services will be incurred on a task order basis (hourly rate), not to exceed the estimated annual amount of Three Hundred Thousand and No/100 Dollars ($300,000.00) for a total estimated amount not to exceed Nine Hundred Thousand and No/100 Dollars ($900,000.00) for the initial term and One Million Two Hundred Thousand and No/100 Dollars if the contract term is extended.

WHEREAS, on January 9, 2018, the City of El Paso awarded Contract No. 2018-431 Automotive Fuel- Diesel and Unleaded to Pinnacle Petroleum, Inc.
WHEREAS, the City finds that the Company is in default of the provisions of the Contract because the vendor failed to deliver the required fuel under the terms of Contract; and
WHEREAS, pursuant to Section 8, Paragraph 8B of the Contract (Termination for Default), the City is authorized to terminate the Contract for default; and
WHEREAS, the City desires to terminate this Contract for Default.
NOW, THEREFORE, BE IT RESOLVED BY CITY COUNCIL OF THE CITY OF EL PASO:
That the Purchasing Director is authorized to notify Pinnacle Petroleum, Inc. that the City is terminating Contract No. 2018-431 Automotive Fuel-Diesel and Unleaded for default pursuant to the provisions and requirements of Section C, Paragraph 8B of the Contract Clauses, due to contractor’s failure to perform and that the termination shall be as of June 25, 2019.

That the City Manager be authorized to sign a Chapter 380 Economic Development Program Agreement (“Agreement”) by and between CITY OF EL PASO (“City”) and THE ANDERSON IMMIGRATION LAW GROUP, LLC. (“Applicant”) in support of an Infill Development project located at 213 S. El Paso Street, El Paso, Texas, 79901. The project includes the rehabilitation of an existing facility to provide for office space and requires the Applicant to make a minimum investment of $1,070,000.00. Over the term of the Agreement, the City shall provide economic incentives not to exceed $40,686.00 in the form of an Incremental Property Tax Rebate and a Construction Materials Sales Tax Rebate.
