            WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, BUJALIL SPINOLA, FELIPE A., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

            WHEREAS, City staff has identified an 889 square feet parcel of land within the limits of Riverside Park for use by the City of El Paso, through its Mass Transit Department, as a Brio station for the Alameda Rapid Transit System Project; and

            WHEREAS, City staff has recommended the identified 889 square foot parcel of land as a  proposed Brio bus station in order to provide public transportation to Riverside Park, as well as, to provide the general public with a Brio bus station with close proximity to surrounding business and residential uses; and

WHEREAS, City staff recommends that there is no feasible and prudent alternative to the proposed use of this identified area as a Brio station for the Alameda Rapid Transit System Project in Riverside Park and that the proposed use as a Brio station includes all reasonable planning to minimize harm to Riverside Park, and

            WHEREAS, the City has given notice to the public by giving notice at least thirty (30) days before the statutory public hearing and has published notice once a week for three consecutive weeks in a newspaper of general circulation as required in the Texas Parks and Wildlife Code Section 26.002.      

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That in accordance with Chapter 26 of the Texas Parks and Wildlife Code, the City Council approves the use of an 889 square feet parcel of  land, a legal description of which is attached hereto as Exhibit “A” and made a part hereof for all purposes, within Riverside Park as a Brio station for the Alameda Rapid Transit System Project based upon its determination that there is no feasible and prudent alternative to the use of the identified parcel within Riverside Park and that the proposed use as a Brio station includes all reasonable planning to minimize harm to Riverside Park.

            WHEREAS, the City of El Paso recognizes that moving events, including but not limited to parades, processionals, races, runs, and walks are essential for a vibrant community and provide a distinct benefit to the local culture and economy; and

WHEREAS, providing some funding support for these activities constitutes an important public purpose or benefit to the City and citizens of El Paso for which the City is willing to expend funds and generally share some of the costs of City services related to these events, including but not limited to traffic control, public safety, and cleanup costs for the events; and

WHEREAS, the City Council approves funding for sponsorship of such events as a part of its annual budget process; and

WHEREAS, the City wishes to offer adequate opportunity to apply for City support in the provision of services required for these events through the clarification and revision of existing guidelines;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

SECTION 1. That the Moving Event Sponsorship Program Guidelines (“Program Guidelines”) (attached hereto as Exhibit “A”) be approved, as recommended by the Planning and Inspections staff.

SECTION 2. That the City Manager or designee(s) be authorized to execute agreements between the City of El Paso and event sponsors for qualifying events; and under the terms of each agreement, the City will provide support by covering certain traffic control, public safety, and cleanup costs; and authorize budget transfers to the appropriate City departments. The amount of funds provided each year to the event sponsors will not exceed the total amount set as part of the respective year’s annual budget process.

SECTION 3That the Program Guidelines may be amended by the City Manager or designee(s) to improve program delivery as deemed appropriate by the City Manager or designee.

In addition, the City did not maintain and was unable to provide the tenant application files for one housing project, and therefore BKD was unable to verify the tenants’ eligibly and rent being charged to the tenant.

• Grants Audit: Of the nine housing project selected for testing by BKD, the City did not perform inspections of units as required on four housing projects during fiscal year 2015.
