             WHEREAS, the City of El Paso (“City”) is accepting a grant from The Andeavor Foundation and the El Paso Community Foundation; and

            WHEREAS, the City Council finds that the Body Worn Camera Program grant will assist in enhancing the El Paso Police Department’s ability to maintain a safe and secure City. 

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

  1. That the City Manager or designee is authorized to accept a grant  for the Body Worn Camera Program, through the Andeavor Foundation and the El Paso Community Foundation, in the amount of $110,000.00 with no cash or in-kind match required, including all understandings and assurances contained therein, and to reject, alter and/or terminate the grant.  In addition, the City Manager or designee is authorized to sign any related paperwork, including but not limited to, authorization of budget transfers, and/or revisions to the operation plan. Further, the City Manager or designee is authorized to execute any grant amendments, corrections or extensions of the grant agreement which increase, decrease or de-obligate program funds.

 

  1. The El Paso City Council agrees that the existence of an award will not be used to offset or decrease total salaries, expenses and allowances that the City receives or provides to its Police Department at or after the time the grant is awarded.

 

  1. That the City of El Paso’s Chief Financial Officer, or designee, is designated as the Financial Officer for this grant.

*R E S O L U T I O N

 

            WHEREAS, Townsquare Media, LLC. (hereinafter referred to as “Grantee”) has submitted an application for a Special Event Permit as per Chapter 13.38 (Special Events) of the El Paso City Code, for the use and closure of rights-of-way within the City of El Paso’s (hereinafter referred to as “the City”) for the Mexican Food Fiesta from 4:00 a.m. on Saturday, August 18, 2018, to 6:00 a.m. on Sunday, August 19, 2018 (hereinafter referred to as the “Event”); and

 

            WHEREAS, The Event will utilize both City and State rights-of-way: and

 

            WHEREAS, The City of El Paso (hereinafter referred to as the “City”) has found the Event serves a public purpose; and

 

            WHEREAS, The State of Texas (hereinafter referred to as the “State”) owns and operates a system of highways for public use and benefit, including North Mesa Street (SH 20) between Franklin Ave. to Texas Ave. within El Paso, Texas; and

 

            WHEREAS, 43 TAC, Section 22.12 establishes the rules and procedures for the temporary closure of portions of the State Highway System for periods of time exceeding four hours; and

 

            WHEREAS, the State in recognition of the public purpose for the Event, provides a means of cooperating with the City for the temporary closure of State right-of-way, provided the closure is in accordance with the requirements of 43 TAC, Section 22.12 and the City enters into an Agreement for the Temporary Closure of State Right-of-Way for the Event (Form TEA 30A).

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO:

 

            That the closure of rights-of-way within the City of El Paso for the Mexican Food Fiesta from 4:00 a.m. on Saturday, August 18, 2018, to 6:00 a.m. on Sunday, August 19, 2018, serves a public purpose of providing cultural and recreational activities for the residents and visitors of the City of El Paso, and in accordance with 43 TAC, Section 22.12, the City Manager be authorized to sign an Agreement For The Temporary Closure of State Right Of Way (Form TEA 30A) by and between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the temporary closure and use of State owned and operated street (s) in excess of four hours for portions of North Mesa Street (SH 20) between Franklin Ave. to Texas Ave. upon the issuance of required permits from the City of El Paso and substantial conformity to the finalized TEA30 agreement between the City of El Paso and State of Texas Department of Transportation. Further that the City Manager be authorized to sign a Contract with the Grantee for the purposes above.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            That the City Council approves a Change Order to the South Central Street and Drainage Improvements Phase I Project, Contract No. 2018-001 with Jordan Foster Construction, LLC,  (“Contractor”) in the amount of ONE hundred NINETY FIVe thousand NINE hundred TWENTY TWO AND 97/100 DOLLARS ($195,922.97) for the additional cost necessary for the operation work to be performed during the Operational Period in which the Contractor will be responsible for relocations of fiber optic cables; and that the City Manager be authorized to establish the funding sources and make any necessary budget transfers.

            WHEREAS, on August 18, 2015, the City of El Paso (City) entered into Contract No. 2015-633R Hotel Occupancy Tax Review Internal Audit with MuniServices, LLC (Assignor) for a term of thirty-six (36) months and two (2) one-year options to extend the Contract;

 

            WHEREAS, after entering into said Contract the trade name of Assignor changed to Avenu MuniServices LLC (Assignee);

 

            WHEREAS, Assignor has requested that the City approve an assignment of the Contract to Assignee;

 

            WHEREAS, the Contract provides that it is not assignable without the consent of the City;

 

            WHEREAS, Assignee has agreed to be responsible for all duties and obligations under the Contract; and

 

            WHEREAS, the City agrees to the assignment of all rights, duties and obligations encompassed in the Contract to Assignee;

           

            WHEREAS, the City also desires to exercise the option to extend the term of said Contract for one additional year for an additional amount of $73,055.00

 

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            THAT the City Manager be authorized to sign Consent to Assignment of Contract No. 2015-633R for review and audit services of the City’s Hotel Occupancy tax revenue from MuniServices, LLC to Avenu MuniServices, LLC and that the City Manager be authorized to exercise the option to extend the term of Contract No. 2015-633R between the City and Assignee for one (1) additional year for an additional amount of $73,055.00.

Motion made by Mayor Pro Tempore Noe, seconded by Representative Ordaz Perez, and unanimously carried to AWARD, AS REVISED Solicitation No. 2018-1411 Police Ordered and Non-Consent Towing of Motor Vehicles to the vendors indicated, for an initial term estimated amount of $2,168,400.00. The award includes the option to extend amount of $1,445,600.00 for a total five (5) year estimated award amount of $3,614,000.00. This service is for police ordered and non-consent towing of motor vehicles when there is an accident and are impounded to the El Paso Police Department Municipal Vehicle Storage Facility.

 

Contract Variance:

 

Ordinance No. 018774 was adopted April 17, 2018 to amend the maximum fee of $100.00 for light duty tows that may be charged within the City of non-consent vehicle tows. The estimated amount remains the same based on the historical data of vehicles impounded.

 

Current bid price for Group 1 (less than 10,000 lbs.) had an average of $84.43, compared to replacement contract of $100.00 which is an increase of 15.57%.

 

This was a recent change to the local ordinance No. 018774, Section 12.54.020 (A) (1) which was adopted April 17, 2018 to increase the light duty vehicle towing to a maximum amount of $100.00 (from $85.46).

 

Current bid price for Group 1 (less than 25,000 lbs.) had an average of $302.78 compared to replacement contract of $350.00 which is an increase of 13.49%. 

 

Current bid price for Group 1 (more than 25,000 lbs.) had an average of $420 compared to replacement contract of $450.00 which is an increase of 6.67%.

 

The combined average percentage totals for 3 groups equal an increase of 11.91%.

The service consists of three neighborhood routes connecting to the Mesa Brio and/or the Westside terminal, plus an express service from the Westside terminal to the Eastside (Cielo Vista) terminal.  These routes were intended to mitigate traffic and reduce congestion and improve air quality.  Sun Metro is enhancing efficiency by using a third-party to provide this service, formerly provided through the use of Sun Metro staff, units and maintenance.

            WHEREAS, pursuant to Section 2267.052 of the Texas Government Code, the City of El Paso (“City”) adopted the Local Guidelines for Public Private Partnerships (“P3 Guidelines”); and

 

            WHEREAS, the City requested proposals though 2016-371R for the Development Opportunity for a Public Private Partnership for a Mixed-use Urban Development, Including Structured Parking at Mills Avenue and Campbell in Downtown El Paso (“Project”); and

 

            WHEREAS, the MEYERS GROUP DEVELOPMENT, LLC./ II Sabes, LP (“Proposer”) submitted a conceptual and detailed proposal; and

 

            WHEREAS, on November 14, 2017 the City accepted the proposals submitted by Proposer in accordance with the procedures established in the City’s P3 Guidelines; and

 

            WHEREAS, on December 12, 2017 the City conducted a public hearing on the proposal; and 

 

            WHEREAS, the parties have completed the negotiations phase for an Interim Agreement Proposal; and

 

            WHEREAS, the City provided notice of the proposed Interim Agreement through the City website and newspaper of a public hearing date regarding the Interim Agreement along with a summary of the proposed Agreement and the location where a redacted copy of the proposed Interim Agreement is available for public inspection prior to holding a public hearing on the proposed Interim Agreement; and 

 

            WHEREAS, the parties desire to enter into the proposed Interim Agreement for the Project after holding a public hearing; and

 

            WHEREAS, more than the minimum of thirty (30) days required in the P3 Guidelines have passed between the public hearing on the accepted proposal and the Interim Agreement.

 

            BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            WHEREAS, the Continuity of Operations (COOP) Basic Plan and appendices was prepared by El Paso City/County Office of Emergency Management to develop, implement and maintain a viable COOP capability;

 

            WHEREAS, the COOP complies with applicable internal policy, other local and state regulations, and supports recommendations provided in Federal Continuity Directive 1 (FCD 1);

 

            WHEREAS, this COOP has been distributed internally within City of El Paso and with external agencies that might be affected by its implementation;

 

            WHEREAS, the Continuity of Government (COG) Plan has been completed and approved through a collaboration of efforts in the Emergency Management Program;

 

            WHEREAS, upon adoption, this document serves as the COG for City of El Paso;

 

            WHEREAS, the COG Plan is a companion to the Continuity of Operations Plans (COOP) developed for each city department; and

 

            WHEREAS, while the COOP ensures the operations of the City departments will continue in the event of an emergency, the COG Plan ensures that the authority needed to continue operations is in place.
