WHEREAS, Townsquare Media, LLC. (hereinafter referred to as “Grantee”) has submitted an application for a Special Event Permit as per Chapter 13.38 (Special Events) of the El Paso City Code, for the use and closure of rights-of-way within the City of El Paso’s (hereinafter referred to as “the City”) for the Mexican Food Fiesta from 4:00 a.m. on Saturday, August 18, 2018, to 6:00 a.m. on Sunday, August 19, 2018 (hereinafter referred to as the “Event”); and
WHEREAS, The Event will utilize both City and State rights-of-way: and
WHEREAS, The City of El Paso (hereinafter referred to as the “City”) has found the Event serves a public purpose; and
WHEREAS, The State of Texas (hereinafter referred to as the “State”) owns and operates a system of highways for public use and benefit, including North Mesa Street (SH 20) between Franklin Ave. to Texas Ave. within El Paso, Texas; and
WHEREAS, 43 TAC, Section 22.12 establishes the rules and procedures for the temporary closure of portions of the State Highway System for periods of time exceeding four hours; and
WHEREAS, the State in recognition of the public purpose for the Event, provides a means of cooperating with the City for the temporary closure of State right-of-way, provided the closure is in accordance with the requirements of 43 TAC, Section 22.12 and the City enters into an Agreement for the Temporary Closure of State Right-of-Way for the Event (Form TEA 30A).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO:

WHEREAS, after entering into said Contract the trade name of Assignor changed to Avenu MuniServices LLC (Assignee);
WHEREAS, Assignor has requested that the City approve an assignment of the Contract to Assignee;
WHEREAS, the Contract provides that it is not assignable without the consent of the City;
WHEREAS, Assignee has agreed to be responsible for all duties and obligations under the Contract; and
WHEREAS, the City agrees to the assignment of all rights, duties and obligations encompassed in the Contract to Assignee;

The award includes the option to extend amount of $1,445,600.00 for a total five (5) year estimated award amount of $3,614,000.00. This service is for police ordered and non-consent towing of motor vehicles when there is an accident and are impounded to the El Paso Police Department Municipal Vehicle Storage Facility.
Contract Variance:
Ordinance No. 018774 was adopted April 17, 2018 to amend the maximum fee of $100.00 for light duty tows that may be charged within the City of non-consent vehicle tows. The estimated amount remains the same based on the historical data of vehicles impounded.
Current bid price for Group 1 (less than 10,000 lbs.) had an average of $84.43, compared to replacement contract of $100.00 which is an increase of 15.57%.
This was a recent change to the local ordinance No. 018774, Section 12.54.020 (A) (1) which was adopted April 17, 2018 to increase the light duty vehicle towing to a maximum amount of $100.00 (from $85.46).
Current bid price for Group 1 (less than 25,000 lbs.) had an average of $302.78 compared to replacement contract of $350.00 which is an increase of 13.49%.
Current bid price for Group 1 (more than 25,000 lbs.) had an average of $420 compared to replacement contract of $450.00 which is an increase of 6.67%.
The combined average percentage totals for 3 groups equal an increase of 11.91%.

R E S O L U T I O N
WHEREAS, pursuant to Section 2267.052 of the Texas Government Code, the City of El Paso (“City”) adopted the Local Guidelines for Public Private Partnerships (“P3 Guidelines”); and
WHEREAS, the City requested proposals though 2016-371R for the Development Opportunity for a Public Private Partnership for a Mixed-use Urban Development, Including Structured Parking at Mills Avenue and Campbell in Downtown El Paso (“Project”); and
WHEREAS, the MEYERS GROUP DEVELOPMENT, LLC./ II Sabes, LP (“Proposer”) submitted a conceptual and detailed proposal; and
WHEREAS, on November 14, 2017 the City accepted the proposals submitted by Proposer in accordance with the procedures established in the City’s P3 Guidelines; and
WHEREAS, on December 12, 2017 the City conducted a public hearing on the proposal; and
WHEREAS, the parties have completed the negotiations phase for an Interim Agreement Proposal; and
WHEREAS, the City provided notice of the proposed Interim Agreement through the City website and newspaper of a public hearing date regarding the Interim Agreement along with a summary of the proposed Agreement and the location where a redacted copy of the proposed Interim Agreement is available for public inspection prior to holding a public hearing on the proposed Interim Agreement; and
WHEREAS, the parties desire to enter into the proposed Interim Agreement for the Project after holding a public hearing; and
WHEREAS, more than the minimum of thirty (30) days required in the P3 Guidelines have passed between the public hearing on the accepted proposal and the Interim Agreement.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:
That the City Manager is authorized to sign the Interim Agreement for Pre-Development between the City of El Paso Texas and the MEYERS GROUP DEVELOPMENT, LLC./ II Sabes, LP for 2016-371R for the Development Opportunity for a Public Private Partnership for a Mixed-use Urban Development, Including Structured Parking at Mills Avenue and Campbell in Downtown El Paso (“Project”), and that the Interim Agreement establishes terms and conditions for the pre-development work of the Project.

WHEREAS, the Continuity of Operations (COOP) Basic Plan and appendices was prepared by El Paso City/County Office of Emergency Management to develop, implement and maintain a viable COOP capability;
WHEREAS, the COOP complies with applicable internal policy, other local and state regulations, and supports recommendations provided in Federal Continuity Directive 1 (FCD 1);
WHEREAS, this COOP has been distributed internally within City of El Paso and with external agencies that might be affected by its implementation;
WHEREAS, the Continuity of Government (COG) Plan has been completed and approved through a collaboration of efforts in the Emergency Management Program;
WHEREAS, upon adoption, this document serves as the COG for City of El Paso;
WHEREAS, the COG Plan is a companion to the Continuity of Operations Plans (COOP) developed for each city department; and
WHEREAS, while the COOP ensures the operations of the City departments will continue in the event of an emergency, the COG Plan ensures that the authority needed to continue operations is in place.
