SPECIAL MEETING OF THE CITY COUNCIL MEETING MINUTES

MAIN CONFERENCE ROOM

November 2, 2015

 

The City Council met at the above place and date.  Meeting was called to order at 9:30 a.m.  Mayor Oscar Leeser present and presiding and the following Council Members answered roll call:  Larry Romero, Carl Robinson, Michiel Noe, Claudia Ordaz, Lilia Limon, and Cortney Niland.  Late arrival:  Peter Svarzbein at 9:32 a.m.  Emma Acosta requested to be excused.

R E S O L U T I O N

WHEREAS, on July 20, 2004, the El Paso City Council adopted a resolution approving the use of alternate project delivery methods for construction projects pursuant to Section 271.113 of the Texas Local Government Code (now Section 2269 of the Texas Government Code) that provides the best value to the City; and

WHEREAS, on Sept. 18, 2012, the El Paso City Council approved the addition of the Construction Manager-at-Risk as an alternate project delivery method for construction projects and adopted the City of El Paso Construction Manager-at-Risk Procurement Policy; and

WHEREAS, the City’s Construction Manager-at-Risk Procurement Policy states that the City Engineer will determine, before advertising, which alternative project delivery method for construction provides the best value to the City and that the El Paso City Council shall approve the issuance of a solicitation for any Construction Manager-at-Risk project prior to its issuance; and

WHEREAS, on August 18, 2015, the El Paso City Council approved the delegation of all authority previously delegated to the City Engineer to the Director of the Capital Improvement Department; and

WHEREAS, the Director of the Capital Improvement Department has determined that the Construction Manager-at-Risk alternative project delivery method will provide the best value to the City for the construction of the Multipurpose Cultural and Performing Arts Center and requests that the El Paso City Council approve of the issuance of a solicitation using Construction Manager-at-Risk delivery method for the construction of the Multipurpose Cultural and Performing Arts Center.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

         THAT the El Paso City Council approves the issuance of a solicitation using the Construction Manager-at-Risk delivery method for the construction of the Multipurpose Cultural and Performing Arts Center.

 

Mr. Bruce Collins, Director of Purchasing and Strategic Sourcing.

 

Mayor Leeser asked, “Who will represent the City’s interest?”

 

Representative Ordaz asked Mr. Collins, “How to go over the process?”

 

Ms. Monica Lombrana, Director of Capital Improvement explained the delivery method and the timeline for the project preparation.

 

Representative Limón questioned specific steps of the timeline.  “Why was this not on the regular agenda?”

 

Mayor Leeser answered.

 

Ms. Sylvia Firth, City Attorney, explained the rules for alternative delivery methods are City rules not State law.  City needs a decision quickly on delivery method to move quickly.

 

Ms. Lombrana stated, “Issue is time sensitive and the City wants the bidders to know exactly what the City is doing.”

 

Representative Svarzbein asked for an explanation as to why this procurement method is being chosen over other methods.

 

Ms. Lombrana explained the particulars.

 

Representative Svarzvein asked, “What was used for the ballpark?”

 

Ms. Lombrana replied, “Construction Manager at Risk.”

 

Representative Svarzbein questioned, “San Jacinto Plaza?”

 

Ms. Lombrana replied, “Low bid.”

 

Mr. Tommy Gonzalez, City Manager, further explained why this method has been chosen.

 

Representative Noe asked for a detailed time of events.

 

Ms. Lombrana went over the timelines.

 

Motion made by Representative Niland, seconded by Representative Romero, and unanimously carried to APPROVE the Resolution.

AYES:  Representatives Svarzbein, Romero, Robinson, Noe, Ordaz, Limón, and Niland

NAYS: None

ABSENT: Representative Acosta

Motion made by Representative Romero, seconded by Mayor Pro Tempore Noe, and unanimously carried to ADJOURN this meeting at 9:40 a.m.
