            That the City Manager is authorized to sign a Lessor’s Approval of the Assignment of Ground Lease, Assignment of Sublease and Assumption by and between the City of El Paso (“Lessor”), GIP El Paso, LLC (“Assignor”), and RCR Palmas, LLC (“Assignee”) for the following described property:

            WHEREAS, the City of El Paso (“Landlord”) and Science Applications International Corporation (“Tenant”) entered into an Air Cargo Center Agreement with an effective date of February 15, 2016, to lease office, warehouse and ground service equipment parking space located at Suite C of the Air Cargo Center, 301 George Perry, Blvd., El Paso, El Paso County, Texas; and

 

            WHEREAS, the Tenant desires to lease additional warehouse and ground service equipment parking space, and other space located at Suite D of the Air Cargo Center;

 

            WHEREAS, the City is willing to lease the referenced space to Tenant, and to offer Landlord’s Additional Improvements to Suite D.

 

            BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

1.    That the City Manager be authorized to sign a First Amendment to Air Cargo Center Agreement (“First Amendment”) with an effective date of February 15, 2016, by and between the City of El Paso (“Landlord”) and Science Applications International Corporation (“Tenant”) to add the following described property:

 

That certain office and warehouse space containing approximately 6,100 square feet, more or less, in total, as shown on Exhibit “A-1” and Exhibit “B-1” to said First Amendment, known as the Air Cargo Center, 301 George Perry Blvd., Suite D, El Paso, El Paso County, Texas, together with portions of the loading dock and vehicle parking space, ground service equipment parking and the non-exclusive use of the roadway in front of and adjacent to the Air Cargo Center, all as set forth therein.

            That the City Council authorizes the Mayor to sign an Interlocal Agreement for Enhanced Public Safety Radio Connectivity between the City of El Paso and The University of Texas at El Paso (“UTEP”) for UTEP to connect to the City’s P25 Public Safety Radio System with their own public safety equipment for a term of ten (10) years from the Effective Date.  The term shall automatically renew for successive one year periods unless terminated by either party; and that UTEP will compensate the City for the system maintenance and equipment cost on a prorated basis based on the number of radios used by UTEP.

A RESOLUTION APPROVING A DETAILED SITE DEVELOPMENT PLAN FOR LOTS 1- 12, BLOCK 8, EASTWOOD SECTION 1, CITY OF EL PASO, EL PASO COUNTY, TEXAS, PURSUANT TO SECTION 20.04.150.  THE PENALTY IS AS PROVIDED FOR IN CHAPTER 20.24 OF THE EL PASO CITY CODE.

 

            WHEREAS, EL PASO HEALTHCARE SYSTEM LIMITED, (the "Owner") has applied for approval of a detailed site development plan which requires City Plan Commission and City Council approval.  The detailed site development plan is subject to the development standards in the C-2 (COMMERCIAL) District regulations and subject to the approved Detailed Site Development Plan signed by the Applicant, the City Manager and the Executive Secretary to the City Plan Commission as required per Ordinance No. 18906, dated February 5, 2019.  A copy of this plan is attached hereto and is incorporated herein by reference for all purposes; and,

 

            WHEREAS, a report was made by the staff to the City Plan Commission and a public hearing was held regarding such application;

 

            WHEREAS, the City Plan Commission has approved and herein recommends Council approval of the subject detailed site development plan; and

 

            WHEREAS, the City Council finds that the detailed site development plan meets all applicable requirements of the El Paso City Code:

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

1.        Pursuant to requirements, the City Council hereby approves the detailed site development plan submitted by the Applicant, as required under the C-2 (Commercial) District as per Section 20.04.150, on the following described property which is located in a C-2 (Commercial) District:

 

LOTS 1- 12, BLOCK 8, EASTWOOD SECTION 1, City of El Paso, El Paso County, Texas.

 

2.                    A copy of the approved detailed site development plan, signed by the Applicant, the City Manager and the Secretary of the City Plan Commission, is attached hereto, as Exhibit "A" and incorporated herein by reference.

 

3.                    All construction and development on the property shall be done in accordance with the approved detailed site development plan and the development standards applicable in the C-2 (COMMERCIAL) District regulations.

 

4.                    The Applicant shall sign an agreement to develop the property and to perform all construction thereon in accordance with the approved detailed site development plan and the standards applicable in the C-2 (COMMERCIAL) District.  Such agreement shall be signed and filed with the Zoning Administrator and the Executive Secretary of the City Plan Commission before building permits are issued.

 

5.    This approval shall be void if construction on the property is not started in accordance with the approved detailed site development plan within four (4) years from the date hereof.

5.2.

*R E S O L U T I O N

 

            WHEREAS, in July of 2013, the property owner submitted a signed and sealed tax exemption application under the requirements of the El Paso City Code section 3.04.035 for the rehabilitation of the property located at 209 N. Stanton Street, in the City of El Paso, El Paso County, Texas, (the “property”) which is a contributing property within the Downtown historic district, and such application was approved by staff;

 

            WHEREAS, the property owner submitted an application to the Historic Preservation Office for a Certificate of Appropriateness of the work to be done on the property in accordance with the requirements of the El Paso City Code Section 20.20.080(E), and the property owner completed the proposed improvements, and staff reviewed the application, the supporting documentation, and conducted a site visit to determine if the preservation work was compliant with the application;

 

            WHEREAS, staff has determined that the work is substantially compliant with the Certificate of Appropriateness application and the Tax Exemption application, and the requirements of the section 3.04.035 of the El Paso City Code; and

 

            WHEREAS, staff has determined that the property owner is eligible for an exemption from any increase in the City’s portion of the accessed ad valorem taxes for a maximum of fifteen (15) years in part because it is a contributing property in the Downtown historic district.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

1.            Pursuant to section 3.04.035 of the El Paso City Code, the property owner of property described as 4 Mills 61.333 ft. on N. Stanton x 120 ft. beg. 86.667 ft. N. of SEC in the City of El Paso, El Paso County, Texas, commonly known as 209 N. Stanton Street is hereby exempt from any increase in the City’s portion of the ad valorem taxes on the value of the improvement for a period of fifteen (15) years beginning on January 1, 2020 and ending December 31, 2034, provided that all City Code requirements are met.  City Council finds that the value of the improvements is equal to 50% of the assessed value of the improvement on the site prior to rehabilitation, and the base improvement value prior to preservation was $450, 200.00.

            WHEREAS, in October of 2012, the property owner submitted a signed and sealed tax exemption application under the requirements of the El Paso City Code section 3.04.035 for the rehabilitation of the property located at 311 Franklin Street (a.k.a. 500 N. Stanton), described as 500 N. Stanton (a.k.a. 311 Franklin Street), in the City of El Paso, El Paso County, Texas, (the “property”) which is listed on the El Paso Inventory of Historic Sites, and such application was approved by staff;

 

            WHEREAS, the property owner submitted an application to the Historic Preservation Office for Administrative Review of the work to be done on the property in accordance with the requirements of the El Paso City Code Section 20.20.080(E), and the property owner completed the proposed improvements, and staff reviewed the application, the supporting documentation, and conducted a site visit to determine if the preservation work was compliant with the application;

 

            WHEREAS, staff has determined that the work is substantially compliant with the Administrative Review application and the Tax Exemption application, and the requirements of the section 3.04.035 of the El Paso City Code; and

 

            WHEREAS, staff has determined that the property owner is eligible for an exemption from any increase in the City’s portion of the accessed ad valorem taxes for a maximum of ten (10) years.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

1.            Pursuant to section 3.04.035 of the El Paso City Code, the property owner of property described as 23 Mills 60 ft. on Stanton X 120 ft. on Franklin SWC in the City of El Paso, El Paso County, Texas, commonly known as 500 N. Stanton (a.k.a. 311 Franklin Street) is hereby exempt from any increase in the City’s portion of the ad valorem taxes on the value of the improvement for a period of 10 years beginning on January 1, 2020 and ending December 31, 2029, provided that all City Code requirements are met.  City Council finds that the value of the improvements is equal to 50% of the assessed value of the improvement on the site prior to rehabilitation, and the base improvement value prior to preservation was $429, 032.00.

            WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, SANDERS, WESTON C., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

 

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

 

700 E Baltimore Dr., more particularly described as Lot 24, Block 29Kern Place Subdivision, City of El Paso, El Paso County, Texas, PID #K216-999-0290-8900

 

to be $327.87, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 8th day of August, 2019, and approves the costs described herein.

 

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED TWENTY SEVEN AND 87/100 DOLLARS ($327.87) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

 

            3.         The City Clerk is directed to give notice of the lien by filing a copy of this Resolution for record with the County Clerk.

 

            4.         All records of the City Clerk’s office relating to the proceeding against the above described property are made a part of this Resolution by reference.

            WHEREAS, El Paso Independent School District (“EPISD”) conveyed to the City of El Paso (the “City”) all of the EPISD’s fee title interest in the property legally described as portion of Tract 5-B-1, Ascarate Addition Block 2, an addition to the City of El Paso, El Paso County, Texas, for the purpose of the City constructing and operating a recreational regional water park (“Water Park”) through its Parks and Recreation Department, and in consideration of the Water Park conveyance;

 

            WHEREAS, the City and EPISD desire to enter into an Interlocal Joint Use Agreement providing EPISD exclusive use during the school year of the City owned Memorial Park softball field (“Softball Field”) located at 3418 Aurora Ave, El Paso, Texas 79930, exclusive use of the Water Park once a year for the first five years after the Water Park opens, and for continuous shared use of parking to be built by City as part of the Water Park;

 

            WHEREASEPISD will design and build approximately $1.3 million in improvements on the Softball Field using 2016 school bond funds and the City will contribute $160,000 toward the improvements;

 

            WHEREASCity and EPISD are authorized to enter into this Agreement under the provisions of Chapter 791, Texas Government Code, by approval of their respective governing bodies;

 

            WHEREAS, the City has provided proper notice to the public at least 30 days before the date of the public hearing and by publishing a notice once a week for three consecutive weeks in a newspaper of general circulation  as required by Texas Parks & Wildlife Code Section 26.002; 

 

            WHEREAS, City Council finds that there is no feasible and prudent alternative to the use of the public park in order to derive the benefits anticipated by the City under the Agreement, and the proposed use under the Agreement includes all reasonable planning to minimize harm to the land as a park and in fact improves the Softball Field; and

 

            WHEREAS, City Council finds that, as a matter of public interest, the Interlocal Joint Use Agreement enhances the quantity and quality of recreational and athletic programs and services for students and citizens, and as such, further a public purpose that benefits EPISD, the City, and the citizens of El Paso in accordance with the terms and conditions herein.

 

            BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            That the Mayor be authorized to execute an Interlocal Joint Use Agreement (“Agreement”) by and between the City of El Paso, Texas (the “City”) and the El Paso Independent School District (the “EPISD”), whereby EPISD may jointly utilize Memorial Park Softball Field and EPISD shall construct and maintain a softball and related facilities for joint use with the City for as long as the referenced Agreement is in effect and the City shall contribute $160,000.00 towards the improvements to Memorial Park Softball Field.

The City shall review the Applicant’s eligibility for Grant Payments on a quarterly and annual basis.

            WHEREAS, the City Council of the City of El Paso, Texas (the “City”), has determined that certificates of obligation should be issued, in one or more series, under and pursuant to the provisions of Texas Local Government Code, Subchapter C of Chapter 271, as amended, for the purpose of paying contractual obligations to be incurred for (i) the construction of public works, (ii) the purchase of materials, supplies, equipment, machinery, land, and rights-of-way for authorized needs and purposes and (iii) for professional services, all as specified below; and

 

            WHEREAS, prior to the issuance of such certificates, the City Council is required to publish notice of its intention to issue the same in a newspaper of general circulation in the City, such notice stating (i) the time and place the City Council tentatively proposes to pass the ordinance authorizing the issuance of the certificates, (ii) the maximum amount proposed to be issued, (iii) the purposes for which the certificates are to be issued and (iv) the manner in which the City Council proposes to pay the certificates;

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO, TEXAS:

 

            SECTION 1: The City Clerk is hereby authorized and directed to cause notice to be published of the City Council’s intention to issue certificates of obligation, in one or more series, in a principal amount not to exceed $100,000,000 for the purpose of paying contractual obligations to be incurred for 

 

(i)          the construction of public works, to wit: (a) constructing, resurfacing, and improving various streets, roads, bridges, overpasses, thoroughfares, sidewalks, pathways and related municipal facilities within the City including lane markings, street drainage, street lights, ADA accessibility, traffic signals, signal system synchronization, loop detectors, transit tunnel reconstruction, lighting, signage, streetscaping, relocation of fiber optics and landscaping related thereto; (b)  designing, constructing and equipping a municipal police parking garage facility; (c) designing, constructing, improving and equipping municipal park, recreational and aquatic facilities, including pools, aquatic centers, spray parks, and public restrooms, and any associated demolition, drainage and necessary infrastructure improvements; (d) designing, constructing, improving and equipping library facilities, museums, and cultural center projects; (e) constructing, acquiring, improving a municipal facility to be used as a tourist center and public restrooms in the downtown area; (f) renovating, improving and equipping existing City buildings and facilities, including rehabilitation, ADA improvements, information technology improvements to install and/or enhance fiber optic connectivity; (g) constructing, acquiring and improving municipally owned public art projects; and (h) the acquisition of any necessary rights of way and/or land in connection with any of the projects described in clauses (a) through (g);

 

(ii)         the purchase of materials, supplies, equipment and machinery, to wit: (a) the purchase and installation of information technology equipment, including hardware, software, network, and Wi-Fi; and (b) the purchase of motor vehicles for the following City departments: public safety, health, parks, information technology, streets and maintenance, capital improvement, and planning and inspection; and

 

(iii)        professional services rendered in connection with (a)such projects and purposes and the financing thereof and (b) a land use masterplan and street pavement condition study.

 

Such certificates to be payable from ad valorem taxes and a limited pledge of the net revenues of the City’s water and sewer system.  The notice hereby approved and authorized to be published shall read substantially in the form and content of Exhibit A hereto attached and incorporated herein by reference as a part of this resolution for all purposes.

 

            SECTION 2: The City Clerk shall cause the aforesaid notice to be published (i) in a newspaper of general circulation in the City, once a week for two consecutive weeks, the date of the first publication to be at least forty-six (46) days prior to the date stated therein for the passage of the ordinance authorizing the issuance of the certificates of obligation and (ii) continuously on the City’s website for at least forty-five (45) days before the date stated therein for the passage of the ordinance authorizing the issuance of the certificates of obligation.

 

            SECTION 3: It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Texas Government Code, Chapter 551, as amended.

 

            SECTION 4: This Resolution shall take effect and be in full force and effect from and after the date of its adoption, and it is so resolved; and all Resolutions of the City Council of the City in conflict herewith are hereby amended or repealed to the extent of such conflict.

            WHEREAS, on December 3, 2002 the City Council of the City of El Paso (‘City”) consented to the creation of Paseo Del Este Municipal Utility Districts Nos. 1 through 9 (“Districts”) in the City of El Paso’s Extraterritorial Jurisdiction; and 

 

            WHEREAS, the City’s consent to the creation of the Districts was subject to several conditions; and

 

            WHEREAS, one of the City’s conditions for the creation of the Districts was that the City is to review and approve the Districts’ bonds and notes prior to issuance and may place restrictions on the terms and provisions of each of the District’s bonds and notes issued to provide service to the land and conditions on the sale of the District’s bonds and notes to the extent such restrictions and conditions do not generally render the bonds and notes of the Districts unmarketable; and

 

            WHEREAS, Paseo Del Este Municipal District No. Nine (“M.U.D. No. 9”) requested review and approval of the issuance of the Unlimited Tax Bonds, Series 2019 Bonds Utility by M.U.D. No. 9 (the “Series 2019 Bonds”); and

 

            WHEREAS, the City reviewed the proposed issuance of Series 2019 Bonds by M.U.D. No. 9 and desires to approve the issuance of the bonds.

            WHEREAS, the City of El Paso has targeted significant investment into public infrastructure in centrally located, strategic investment areas to support economic development and revitalization of core neighborhoods; and

 

            WHEREAS, it is the intent of the City of El Paso to revitalize neighborhoods near El Paso’s downtown footprint and ensure that continued investment in these areas is supported by affordable housing options for all El Pasoans, including current residents of those neighborhoods; and

 

            WHEREAS, residents of priority reinvestment areas should have affordable opportunities to improve and preserve the condition of their homes.

 

            NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

R E S O L U T I O N

 

            WHEREAS, in 2007, the 80th Texas Legislature passed House Bill 2391, which amended the Texas Code of Criminal Procedure Section 14.06 relating to the appearance of certain misdemeanor offenders before a magistrate; and

 

            WHEREAS, House Bill 2391 authorizes a peace officer charging a person with certain Class A or B misdemeanors to issue a citation with written notice of a later time and place to appear before the magistrate instead of taking the person immediately before the magistrate if that person resides in the county where the offense occurred ("cite and release"); and

 

            WHEREAS, House Bill 2391 enumerated these certain misdemeanors to include Class A and B possession of marijuana; and

 

            WHEREAS, on August 6, 2019, the El Paso City Council was briefed on the history of House Bill 2391; history on cite and release implementation in other Texas municipalities; options and the process for implementing a cite and release program for Class A and B possession of marijuana; and the goals of a cite and release program;

 

            WHEREAS, even short periods of incarceration are strongly correlated with higher rates of new criminal activity; when held as few as 2 or 3 days, low-risk defendants arc almost 40 percent more likely to commit new crimes before trial than defendants held for fewer than 24 hours; and

 

            WHEREAS, arrests for misdemeanor possession of marijuana result in a significant drain on our police department, pre-trial services and court resources, requiring countless man hours and tax dollars to arrest, transport, book, supervise, coordinate, and process paperwork for each alleged offender; and

 

            WHEREAS, because the City Council still seeks to further the goals of reducing jail population for non-violent offenders, reducing the time officers spend on jail processing procedures, and improving response times by getting officers back into service quicker, a cite and release program for Class A and B misdemeanor possession of marijuana is in the best interest of the City of El Paso and its citizens;

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

SECTION 1. That the City Manager is directed to meet with the stakeholders and make recommendations to implement a cite and release program.

 

SECTION 2. That the City Manager provide quarterly reports to City Council regarding the cite and release program for the purposes of transparency, to provide data concerning the use of discretionary arrest in lieu of citation for nonviolent misdemeanor offenses when a ticket or citation would be allowed by state law.
