The City Council met in regular session at the above place and date.  Meeting was called to order at 8:04 a.m.  Mayor Oscar Leeser present and presiding and the following Council Members answered roll call: Jim Tolbert, Emma Acosta, Michiel Noe, and Lilia Limón.  Late Arrivals: Carl Robinson at 8:06 a.m., Claudia Ordaz at 8:09 a.m., Peter Svarzbein at 8:10 a.m., and Cortney Niland at 8:56 a.m., and The invocation was given by Police, Fire and CIMA Chaplain Sam Faraone, followed by the Pledge of Allegiance to the Flag of the United States of America.

WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, SANCHEZ, DANIEL & JUAN M., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices.  In accordance with El Paso City Code Chapter 9.04, the Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

to be $589.56, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 12th day of August, 2016, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount FIVE HUNDRED EIGHTY NINE AND 56/100 DOLLARS ($589.56) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

Goal 4: Enhance El Paso’s Quality of Life through Recreational, Cultural and Educational Environments

4.1.

*R E S O L U T I O N

WHEREAS, the County of El Paso (hereinafter referred to as “Property Owner”), wishes to annex approximately 3.0370 acres of real property described in Exhibit “A” and Exhibit “B” which are attached and incorporated for all purposes; and,

WHEREAS, the Property is not within the corporate limits of any municipality but is contiguous to the corporate limits of the City; and

WHEREAS, Property Owner desires that the Property be annexed to the City in order to provide adequate and efficient improvements and facilities; and

WHEREAS, Ranchos Real Land Holdings, LLC (hereinafter referred to as “Developer”), has agreed to be responsible for all costs relating to annexation and right-of-way improvements as described herein; and

WHEREAS, Property Owner will not be responsible for any of the costs of annexation or right-of-way improvements as described herein; and

WHEREAS, Property Owner and Developer, after full consideration, accept the terms and conditions cited in this Agreement due to the advantages and benefits resulting from the annexation and development of the Property; and,

WHEREAS, the City, after due and careful consideration, and after consultation and approval of the El Paso Water Utilities-Public Service Board, has concluded that should the City decide to annex the Property the annexation should be under the terms and conditions hereinafter set forth and that such terms and conditions are in the best interest of the City to protect and provide for the public health, safety, morals and general welfare.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Manager or his Designee is authorized to sign an Annexation Agreement between the City and El Paso County, for 3.0370 acres of real property located east of John Hayes at Edgemere Boulevard, which will specify the terms and conditions in which the property will be annexed should the City annex the property. Furthermore, that the City Manager or his Designee is authorized to provide any and all notices required under law in order to annex this property.

That the Deputy Director of Planning is hereby directed to prepare an annexation service plan in accordance with Section 43.056 of the Local Government Code.

*R E S O L U T I O N

WHEREAS, Ordinance No. 018059, approved by the City Council of the City of El Paso on August 6, 2013, authorizes the Council to declare limited periods of “amnesty” to allow borrowers of items from the El Paso Public Library to return overdue items or items previously considered lost, without payment of the applicable overdue fines or fees for lost items: and

WHEREAS, The Library desires to encourage donations of canned and non-perishable food donations to the MLK Canned Food Drive, an initiative of the City of El Paso, as well as the return of overdue or items previously considered lost to the Library.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the period of January 3 through January 14, 2017 be declared “Food for Fines Period” for the El Paso Public Library (the “Library”) to waive $1.00 worth of fines for every canned or non-perishable food donation made to the MLK Canned Food Drive at Library locations up to $5.00 per day provided all materials are returned in good condition, as defined in the Library Rules and Fee Structure.

4.4.

*R E S O L U T I O N

WHEREAS, The City of El Paso ("City") through the City's Parks and Recreation Department, will host the Celebration of Lights Parade and Tree Lighting Ceremony from 1:00 p.m. on Saturday, December 3, 2016 to 2:00 a.m. on Sunday, December 4, 2016 (hereinafter referred to as “Event”); and

WHEREAS, The City has found the Event serves a public purpose; and

WHEREAS, The State of Texas (hereinafter referred to as the “State”) owns and operates a system of highways for public use and benefit, including North Mesa Street (SH 20) within El Paso, Texas; and

WHEREAS, The Event will utilize both City and State rights-of-way: and

WHEREAS, 43 TAC, Section 22.12 establishes the rules and procedures for the temporary closure of portions of the State Highway System for periods of time exceeding four hours; and

WHEREAS, the State in recognition of the public purpose for the Event, provides a means of cooperating with the City for the temporary closure of State right-of-way, provided the closure is in accordance with the requirements of 43 TAC, Section 22.12 and the City enters into an Agreement for the Temporary Closure of State Right-of-Way for the Event (Form TEA 30A).

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF EL PASO:

            That the closure of rights-of-way within the City of El Paso for the Celebration of Lights Parade and Tree Lighting Ceremony from 1:00 p.m. on Saturday, December 3, 2016 to 2:00 a.m. on Sunday, December 4, 2016 serves the public purpose of providing cultural and recreational activities for the residents and visitors of the City of El Paso, and in accordance with 43 TAC, Section 22.12, the City Manager is authorized to sign an Agreement For The Temporary Closure of State Right Of Way (Form TEA 30A) between the City of El Paso and the State of Texas, acting by and through the Texas Department of Transportation, for the temporary closure and use of State owned and operated street(s) in excess of four hours for portions of North Mesa Street (SH 20), between Franklin Avenue and San Antonio Avenue, El Paso, Texas.

            WHEREAS, pursuant to the City’s 2016 calendar year City Council regular meeting schedule, City Council is scheduled to meet on Tuesday, December 13, 2016; and

 

            WHEREAS, the City Council desires to reschedule the December 13, 2016 meeting to be held instead on Tuesday, December 6, 2016; and

           

WHEREAS, the rescheduling of this meeting complies with Section 3.5 of the City Charter.

 

            NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

      That the regular City Council meeting scheduled for Tuesday, December 13, 2016 is hereby rescheduled for Tuesday, December 6, 2016.

            THAT the City finds that Bank of America through Corelogic showed a good cause to extend the deadline to apply for a refund of the overpayment of the 2011 taxes and the tax refund in the amount of $22.25 is approved.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            THAT the City finds that Leann Molina through Corelogic showed a good cause to extend the deadline to apply for a refund of the overpayment of the 2011 taxes and the tax refund in the amount of $306.24 is approved.

            THAT the City finds that Guadalupe Sandoval showed a good cause to extend the deadline to apply for a refund of the overpayment of the 2011 taxes and the tax refund in the amount of $100.00 is approved.

            WHEREAS, City Council may extend the deadline for the Taxpayer’s application for the overpayment of the 2011 taxes for a period not to exceed two years on a showing of good cause by the taxpayer; and

WHEREAS, the City of El Paso adopted Ordinance Number 017167 which requires that any vacancy in the membership of the El Paso Water Utilities Public Service Board be filled by the City Council;

WHEREAS, the City of El Paso by Resolution established the El Paso Water Utilities Public Service Board Selection Committee, to be comprised of the members of the Public Service Board and such additional members as appointed by the City Council to assist City Council in selecting eligible candidates to fill the vacancy;

WHEREAS, under the Resolution, the El Paso Water Utilities Public Service Board Selection Committee reviews resumes submitted by persons interested in filling the vacant position and submits to the City Council the names and the ranking of three eligible candidates; and

WHEREAS, a quorum of the El Paso Water Utilities Public Service Board Selection Committee met on October 26, 2016 pursuant to the Texas Open Meetings Act and approved the nomination, ranking and recommendation of an eligible candidate for consideration and reappointment by City Council, based on the single application received for the position.
