That the City Manager be authorized to sign a Lessor's Approval of Assignment by and among the City of El Paso ("Lessor"), F & T Joint Venture ("Assignor"), and TJW Aviation, LLC ("Assignee") for the assignment of the General Aviation Commercial Ground Lease for the following parcel:

 

Lot(s) 14 and 15, Block 4, El Paso International Airport Tracts, City of El Paso, El Paso County, Texas, containing approximately 40,000 square feet of land, and commonly known as 7201 Boeing Drive, City of El Paso, El Paso County, Texas.

            WHEREAS, the City of El Paso (“Lessor” or “City”) owns the premises and improvements located at 400 W. San Antonio, Suite B, El Paso, Texas, 79902 (“Premises”).

 

            WHEREAS, eighty percent (80%) of the cost of construction of the Premises was paid through a grant from the United States Department of Transportation, through the Federal Transit Administration. 

           

            WHEREAS, the Government of the Country of El Salvador (“Lessee”) desires to enter into a lease agreement with Lessor for use of the Premises as the location of the El Salvadoran Consulate.

           

             WHEREAS, Lessor has determined that use of the Premises by Lessee would benefit the City of El Paso by serving the public purpose of providing consulate services to the residents of the City; fostering the City of El Paso’s relationship with the Government of El Salvador; and growing the City of El Paso’s international visibility;

           

            WHEREAS, the lease agreement between Lessor and Lessee limits the use of the Premises by Lessee solely as the Consulate for the Government of El Salvador;  

           

            WHEREAS, Lessee has indicated a willingness and ability to use the property solely to provide consulate services in accordance with the terms of this Lease;

 

            WHEREAS, the Federal Transit Administration has reviewed the proposed lease between the City and the Lessee and has approved the terms of said lease.

 

            NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

                       

            THAT the City Manager is hereby authorized to sign, on behalf of the City of El Paso, a lease with the Government of the Country of El Salvador for the lease of 400 W. San Antonio, Suite B, El Paso, Texas 79902, for a two-year term, at a rental amount of five hundred dollars ($500.00) per month, with one two-year term extension option subject to a five percent (5%) increase in rent.

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

            1.         The City Council determines its reasonable expenses including administrative costs and the cost of removing the accumulated trash, vegetation and weeds or other rubbish located on the property known as:

 

8620 Centennial Dr., more particularly described as Lot 6 (13923.19 Sq. Ft.), Block 66West Hills #20 Subdivision, City of El Paso, El Paso County, Texas, PID #W145-999-0660-0600

 

to be $363.05, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 29th day of August, 2018, and approves the costs described herein.

 

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED SIXTY THREE AND 05/100 DOLLARS ($363.05) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

The Purchasing & Strategic Sourcing and Capital Improvement Departments recommend award as indicated to BLACK STALLION CONTRACTORS INC, the lowest responsive, responsible bidder.

 

It is requested that the City Manager be authorized to establish the funding sources and make any necessary budget transfers and execute any and all documents necessary for execution of this award.

 

Work under this unit price contract is only an estimated value and will be ordered, performed, invoiced, and paid by measured quantity. The actual cost of this contract may be higher or lower than the total estimated value and will be the sum total of unit prices at the end of the contract term.

This work consists of the construction of the Rapid Transit infrastructure for the Montana Corridor from Copia St. to Tierra Este Rd. The scope of this project will include construction of 24 complete rapid transit stations and station amenities approximately 250 ft. to each side of the stations. This is a Low Bid, unit price contract.

 

The Purchasing & Strategic Sourcing and Capital Improvement Departments recommend award as indicated to VENEGAS ENGINEERING MANAGEMENT AND CONSTRUCTION, INC, the lowest responsive, responsible bidder. The award is contingent upon TXDOT concurrence.

 

It is requested that the City Manager be authorized to establish the funding sources and make any necessary budget transfers and execute any and all documents necessary for execution of this award. Contingent upon concurrence of award by TXDOT

 

Work under this unit price contract is only an estimated value and will be ordered, performed, invoiced, and paid by measured quantity. The actual cost of this contract may be higher or lower than the total estimated value and will be the sum total of unit prices at the end of the contract term.

 

As part of this award, upon the review of the City Attorney, the City Engineer may without further authorization from City Council approve contract change orders necessary for proper contract administration in accordance with Texas Department of Transportation (TXDOT) requirements which do not revise the estimated award and change orders that are in accordance with applicable law.

            WHEREAS, The City of El Paso (“City”) and the El Paso County Community College District (“EPCC”) desire to enter into a non-binding Mutual Cooperation Agreement Proposed Term Sheet  regarding the Mexican American Cultural Center at 501 N. Oregon St., El Paso, Texas 79901 (“Cultural Center”); and

 

            WHEREAS, the City intends to provide EPCC a non-exclusive license to operate a restaurant and teaching kitchen (“Culinary Program”) in the Cultural Center; and

 

            WHEREAS, the City and EPCC intend the Mutual Cooperation Agreement Proposed Term Sheet to assist with the basic parameters for the operation of Culinary Program located inside the Cultural Center.

 

            WHEREAS, the City Council approves the Mutual Cooperation Agreement Proposed Term Sheet between with EPCC for the Culinary Program located at the Cultural Center.

 

            NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL AS FOLLOWS:

            WHEREAS, the City of El Paso adopted Ordinance Number 017167 which requires that any vacancy in the membership of the El Paso Water Utilities Public Service Board of Trustees be filled by the City Council; and,

 

            WHEREAS, the City of El Paso by Resolution established the El Paso Water Utilities Public Service Board Selection Committee, to be comprised of the members of the Public Service Board and such additional members as appointed by the City Council to assist City Council in selecting eligible candidates to fill the vacancy; and,

 

            WHEREAS, under the Resolution, the El Paso Water Utilities Public Service Board Selection Committee reviews resumes submitted by persons interested in filling the vacant position and submits to the City Council the names and the ranking of three eligible candidates;

Motion made by Mayor Pro Tempore Noe, seconded by Representative Rivera, and unanimously carried that the City Council retire into EXECUTIVE SESSION at 2:04 p.m. pursuant to Section 3.5A of the El Paso City Charter and the Texas Government Code, Sections 551.071 - 551.089 to discuss any of the following:

Motion made by Representative Rivera, seconded by Mayor Pro Tempore Noe, and unanimously carried to adjourn the Executive Session at 5:52 p.m. and RECONVENE the meeting of the City Council, during which time motions were made.

Motion made by Mayor Pro Tempore Noe, seconded by Representative Ordaz Perez, and carried to APPROVE the amended, restated employment agreement with Thomas Gonzalez AS REVISED, to resave vacation benefits, clarify salary reduction provisions, clarify the provisions and benefits under severance, and clarify the addendum provision.

R E S O L U T I O N

 

            WHEREAS, the health, safety and welfare of the citizens of the City of El Paso are matters of paramount importance to the City Council; and

 

            WHEREAS, multi-agency participation is essential to further enhance safety measures on the roadways within the city limits; and

 

            WHEREAS, the city of El Paso has a strategic goal and strategy to set the standard for a safe and secure city.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

 

  1. That the City of El Paso will seek to obtain information from the Texas Department of Transportation regarding traffic and safety of roadways with in the City of El Paso.
