*R E S O L U T I O N A RESOLUTION REFERRING THE ALLOCATION OF TIRZ 5 FUNDING TO THE FATHER RAHM STREET IMPROVEMENT PROJECT BACK TO THE TIRZ 5 BOARD FOR THEIR CONSIDERATION WHEREAS, by City of El Paso Ordinance No. 016528, adopted December 19, 2006, the City created Tax Increment Reinvestment Zone Number Five, City of El Paso, Texas (“the Zone” or “TIRZ 5”), establishing the boundaries of the Zone as described therein, pursuant to the provisions of the Tax Increment Financing Act, Chapter 311, Texas Tax Code (as amended, the “Act”); later amended by Ordinances Nos. 016803 and 016804 on December 18, 2007, by Ordinance No. 017821 on July 17, 2012, by Ordinance No. 017861 on August 28, 2012, and by Ordinance No. 018049 July 30, 2013; and WHEREAS, by City of El Paso Ordinance No. 016528, adopted December 19, 2006, the City Council approved and adopted the Preliminary Project and Financing Plan, pursuant to Sections 311.011(d) of the act, on February 12, 2009, by Ordinance No. 017081, the City Council approved the Final Project Plan and Final Reinvestment Zone Financing Plan after their adoption by the Board of Directors (the “Board”) of the Zone; later amended on April 7, 2009 by Ordinance No. 017102, November 18, 2009 by Ordinance No. 017239, December 22, 2009 by Ordinance No. 017258, November 8, 2011 by Ordinance No. 017674, May 15, 2012 by Ordinance No. 017788, July 17, 2012 by Ordinance No. 017821, August 28, 2012 by Ordinance No. 017861, July 30, 2013 by Ordinance No. 018049, March 4, 2014 by Ordinance No. 018132, January 6, 2015 by Ordinance No. 018302, September 6, 2016 by Ordinance No. 018566, and October 4, 2016 by Ordinance No. 018578; and WHEREAS, the Board continues to support the City in development activities for the Zone and actively participates in planning and identifying potential projects within the Reinvestment Zone; and WHEREAS, on November 14th, 2016 the Board denied Amending the TIRZ 5 Final Project and Financing Plan to allocate TIRZ 5 funding to the Father Rahm Street Improvement Project; and WHEREAS, the Board Bylaws allow the Board to reconsider an item which has been referred back to the Board by the City Council of the City of El Paso; and WHEREAS, the City Council of the City of El Paso is referring the Father Rahm funding item back to the TIRZ 5 Board for consideration. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO THAT: The TIRZ 5 Board reconsider Amending the TIRZ 5 Final Project and Financing Plan to allocate TIRZ 5 funding to the Father Rahm Street Improvement Project. |

R E S O L U T I O N WHEREAS, the CITY OF EL PASO, a Texas home rule municipal corporation (hereinafter referred to as “City”), TIBH INDUSTRIES, INC., a private non-profit corporation and the certifying party (“TIBH”) and PROFESSIONAL CONTRACT SERVICES, INC. (“PCSI”), the performing party (the certifying and performing parties are hereinafter jointly referred to as “Contractor”) desire to enter into a Contract for Cleaning Services; and WHEREAS, City is in need of various cleaning services for the restrooms and other common use areas of the El Paso International Airport (“EPIA”) terminal building; WHEREAS, Contractor is qualified to provide such cleaning services; WHEREAS, PCSI is certified by the TIBH as providing employment for the blind and/or severely disabled; WHEREAS, City has determined that it is in the best interest of the citizens of El Paso to employ citizens with disabilities to perform the services requested herein; and WHEREAS, the competitive bidding requirements of Texas Local Government Code Section 252.021 do not apply to this Contract, which is in compliance with Chapter 122 of the Human Resources Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO: That the City Manager be authorized to sign a Contract for Cleaning Services, by and between the City of El Paso and TIBH Industries, Inc., and Professional Contract Services, Inc. for cleaning services at the El Paso International Airport Terminal.
