WHEREAS, effective January 1, 2013, the City of El Paso entered into a lease with Texas Tech University Health Science Center for the AB Fall Mansion, which consists of a portion of Lots 11-14, Block 5, Golden Hill Addition, City of El Paso, El Paso County, Texas and certain improvements located thereon, and municipally known and numbered as 1725 Arizona Avenue, El Paso, Texas 79902, at a rental amount of $1 per annum for a three-year term and two one-year extension options;  

            WHEREAS, because notice to exercise the first one-year extension option to extend the lease term was not received timely, staff recommends that the City Council waive  the 60-day notice period to extend the term of the lease and to allow for the exercise of  the first one year option; and

WHEREAS, the City of El Paso and Texas Tech University Health Science Center desire to extend the term of the Lease for an additional term of one (1) year, commencing January 3, 2016,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO, TEXAS:

That the City Manager is authorized to extend the term of the lease with Texas Tech University Health Science Center for the AB Fall Mansion which consists of a portion of Lots 11-14, Block 5, Golden Hill Addition, City of El Paso, El Paso County, Texas, municipally known and numbered as 1725 Arizona Avenue, El Paso, Texas 79902, for a period of one (1) year until January 2, 2017.  All provisions of the lease shall continue in full force and effect for the one year extension.

            WHEREAS, on December 31, 2013, the County of El Paso as Landlord and the City of El Paso as Tenant entered into a Lease Agreement for the premises located at 4505 Alberta, El Paso, Texas (the “Lease”); and

            WHEREAS, Landlord and Tenant desire to extend the term of the Lease, to commence January 1, 2016, and continuing on a month-to-month basis.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            That the City Manager be authorized to sign the Second Amendment to the Lease extending the term of the Lease, to commence January 1, 2016, and continuing on a month-to-month basis.

            That the City Council hereby waives the two factor requirement to designate a property with an infill development overlay pursuant to Municipal Code 20.10.280A for the following property legally described as a Lot 44, Block 41, Vista Real #3, 3504 Oxcart Run Street, City of El Paso, El Paso County, Texas.

to be $355.47, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 22^nd day of June, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED FIFTY FIVE AND 47/100 DOLLARS ($355.47) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            3.         The City Clerk is directed to give notice of the lien by filing a copy of this Resolution for record with the County Clerk.

            4.         All records of the City Clerk’s office relating to the proceeding against the above described property are made a part of this Resolution by reference.

            WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

to be $341.54, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 8th day of July, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED FOURTY ONE AND 54/100 DOLLARS ($341.54) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

to be $381.32, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 2nd day of June, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount THREE HUNDRED EIGHTY ONE AND 32/100 DOLLARS ($381.32) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount SIX HUNDRED SEVENTY AND 48/100 DOLLARS ($670.48) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

to be $440.72, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 2nd day of June, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount FOUR HUNDRED FOURTY AND 72/100 DOLLARS ($440.72) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.
