The City Council met in regular session at the above place and date.  Meeting was called to order at 8:04 a.m.  Mayor Oscar Leeser present and presiding and the following Council Members answered roll call:  Carl Robinson, Claudia Ordaz, Lilia Limón, and Cortney Niland.  Late arrivals:  Emma Acosta at 8:11 a.m., Peter Svarzbein at 8:31 a.m., and Michiel Noe at 9:02 a.m.  Absent:  Larry Romero requested to be excused.  The invocation was given by Police, Fire and CIMA Chaplain Sam Faraone, followed by the Pledge of Allegiance to the Flag of the United States of America

WHEREAS, effective January 1, 2013, the City of El Paso entered into a lease with Texas Tech University Health Science Center for the AB Fall Mansion, which consists of a portion of Lots 11-14, Block 5, Golden Hill Addition, City of El Paso, El Paso County, Texas and certain improvements located thereon, and municipally known and numbered as 1725 Arizona Avenue, El Paso, Texas 79902, at a rental amount of $1 per annum for a three-year term and two one-year extension options;  

            WHEREAS, because notice to exercise the first one-year extension option to extend the lease term was not received timely, staff recommends that the City Council waive  the 60-day notice period to extend the term of the lease and to allow for the exercise of  the first one year option; and

WHEREAS, the City of El Paso and Texas Tech University Health Science Center desire to extend the term of the Lease for an additional term of one (1) year, commencing January 3, 2016,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO, TEXAS:

That the City Manager is authorized to extend the term of the lease with Texas Tech University Health Science Center for the AB Fall Mansion which consists of a portion of Lots 11-14, Block 5, Golden Hill Addition, City of El Paso, El Paso County, Texas, municipally known and numbered as 1725 Arizona Avenue, El Paso, Texas 79902, for a period of one (1) year until January 2, 2017.  All provisions of the lease shall continue in full force and effect for the one year extension.

            WHEREAS, on December 31, 2013, the County of El Paso as Landlord and the City of El Paso as Tenant entered into a Lease Agreement for the premises located at 4505 Alberta, El Paso, Texas (the “Lease”); and

            WHEREAS, Landlord and Tenant desire to extend the term of the Lease, to commence January 1, 2016, and continuing on a month-to-month basis.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

            That the City Manager be authorized to sign the Second Amendment to the Lease extending the term of the Lease, to commence January 1, 2016, and continuing on a month-to-month basis.

            That the City Council hereby waives the two factor requirement to designate a property with an infill development overlay pursuant to Municipal Code 20.10.280A for the following property legally described as a Lot 44, Block 41, Vista Real #3, 3504 Oxcart Run Street, City of El Paso, El Paso County, Texas.

to be $600.39, in accordance with the El Paso City Code Section 9.04.880 and the Texas Health & Safety Code Section 342.007.  The City Council finds that the work was completed on the 8th day of June, 2015, and approves the costs described herein.

            2.         The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount SIX HUNDRED AND 39/100 DOLLARS ($600.39) to be a lien on the above described property, said amount being due and payable within ten (10) days from the date of City Council approval, and thereafter bearing ten percent (10%) interest per annum.

Motion made by Representative Niland, seconded by Mayor Pro Tempore Noe, and unanimously carried that the City Council retire into EXECUTIVE SESSION at 10:42 a.m. pursuant to Section 3.5A of the El Paso City Charter and the Texas Government Code, Sections 551.071 - 551.087 to discuss any of the following:
